Well we know for certain the contract existed

We know Novacyt developed PROmate as an alternative to the initial test.

We know both tests have been used globally by other clients.

We know both tests have passed rigorous CTDA approval.

We know the DHSC took two deliveries of PROmate and have paid for neither.

What we don't know are the exact grounds for claiming that the initial tests were not fit for use/ too difficult to use. We know that the initial tests supplied have subsequently undergone changes , check IFU's. However most assays undergo ongoing changes and it is difficult to ascertain if those changes in this particular case are organic or as a direct result of an issue encountered.

Ncyt endeavoured to replace tests at cost as a remedy and it appeared that this was accepted hence the two PROmate orders , we all know the following chain of events.

Now had the DHSC paid for the PROmate and ordered a greater quantity there would be no court case to answer. It is obvious ( to me anyway ) that without doubt Novacyt tried to satisfy the DHSC and the DHSC chose not to cooperate.Now whether this has bearing on how a judge views the case in its entirety , I don't have a definitive answer.

I suspect it may well carry a great deal of weight in the overall proceedings .. Time will tell.

One cannot discount either the pressure Ncyt were put under to mass produce and fast !

Who said what, when and to whom , who viewed the tests prior to ordering and who signed off on all the individual training sessions prior to use in individual trusts are all factors unknown to me and what Impact such things will have.

I too think as the days in court draw nearer, a compromise will be reached .

None of the above alters my opinion on the abysmal performance to date.

I cannot wait until this is resolved and hopefully we can breathe a collective sigh of relief.

I may be totally wrong , but I think JM is there until at least after June 2023 as he is probably best placed to manage all the tax implications of the case and I've no doubt they will be plentiful

I do not see posting a link to the 'Defence journal 'as cat calling , I even prefixed it with 'small'. As Broomtree stated , there is a natural interest in competitors.

I made my feelings abundantly clear with regards to H&W benefitting in anyway from the misfortunes of others , throughout the posting on the Petrel at Imperial dock Leith , when 35 people were injured.

I work from a base assumption that folks will know that we too could experience this & likewise contractors unhappy with paid rate and downing tools.

Not here to spoonfeed , am positive those invested are well aware of all the pros and cons.

Evening Mr B O B , I used the caveat 'if'. Now for those who listened intently to the judges response to the section directly after the applicants had a chance to respond to our barristers , specifically the five/ten minutes after their 'pen' example ... he made his feelings more then clear imo. Each to their own. Needless to say I was quite a happy bunny .

So you are either in or or out when the news lands. If positive this will go vertical. In the interim folks will mention placings and problems with finance. The choice is down to each of us.

Gas prices have been predicted to nearly treble this winter across Europe.

If it got heated and they were put on the spot , then deservedly so , I see no reason as to why they should not be held 100 % accountable for the dismal performance to date.

I RESERVE judgement on the DHSC debacle , however the lack of a clear signposted strategy , lack of organic growth , woffle about M&A is totally inexcusable imo.

Not impressed at all.

Well I consider you one of the more balanced posters, however have heard so many horror stories personally won't avail of it.

In the interim I'm really impressed with the work flow thru Belfast and there definitely is a marked increase of vessels arriving in dry dock.

Anyone know the whereabouts of Cory barge 2 ?
