Personally can understand individuals different viewpoints , don't believe certain individuals have ever held but that is just imo.
It is entirely feasible that Novacyt's preferred route is to settle , they were willing to replace goods and the stance may have advanced to we are prepared to forgo x percentage of monies owing. I picked up on JM mentioning settling and maybe the DHSC may accept this, as they too would avoid costly court/ barrister/ lawyer costs and avoid the risk of losing outright.
One of Novacyt's negotiating chips have to be that the DHSC would be fiscally better off accepting this, as even an outright win would not guarentee full pyt. Ncyt would have to pay in stages , would not be able to retain quality staff as payrises , Ltips , bonuses etc would all be under scrutiny. How long would Ncyt last in this scenario , what would be the incentive to achieve. Survival ? There are plenty of other companies out there that they could join.
Perhaps... this is why JM dropped news on Biosensers as casually as he did , whereby the company developing them call it disruptive new tech. Keep everything low key , no great potential . This is a drum B2HS2L has beaten re takeovers , I think it could equally he applicable when looking at the DHSC. In this scenario David Allmond performed his role to perfection , note JM saying something akin to decision to change CEO last year.
He did not leave of his own volition , the intention was always for JM to be caretaker until the dispute is done and dusted and his relationship with the staff remains intact after D.A oversaw all the redundancies. He certainly appeared to have managed the closure of Microgen and downsizing . I don't believe for a second that he made that decision and he could well have been actively encouraged to take a 100 days to perform a review. If JM and JW hadn't approved then he would have been made to get on with it ASAP
Not saying any of this is fact , it's a possible maybe and then hey presto all of a sudden we have a plethora of diagnostic assays ( not just RUO ) and new biosensors.
I still believe we could win outright , always have , but I see merit in settling although it leaves a very sour taste in my mouth.
