However milestone pyt must have been achieved so talking perhaps 4.25mm deferred worst case scenario and dependant on when they announce full year may well be in receipt of said funds. Think they said one barge every five weeks . They could pull it off !

Thanks Si , so as we know from Hansard reports they wanted a chunk of the levelling up funding to ultimately be used to subsidise the airline.

The legal challenge they reference must be lack of competition for use of public funds. If H & W ultimately win it, I don't forsee any long term wrangles.

An over ambitious delivery date may be an entirely diff issue. So they are obviously miffed ! One has to assume the DOT will still award LUF as H&W still progressing plans.

Having spent so long prior to the JR preparing their case, I would imagine it is difficult to find any supposed malpractice by Mr Poots that they wouldn't have included in the JR.

However that being said by several lawyers & ex lawyers, they have also said that don't be suprised if they try.

The fact they've pursued it through the courts should make it crystal clear that the enablers have about as much chance of succeeding as me becoming a swampy;))

It's not a case of right or wrong , all the literature you read related to appeals states 28 days. However, I found one amongst perhaps 30 that stated 28 days from receipt of court order ( the JR) now they could have collected from court to speed up and the 28 days starts to tick. However as is the norm I expect they waited until received and then started the 28 days. Hence I wrote for clarification to the company on date. Statistically if you do appeal, they have a very low success rate and we had a resounding victory at JR. If they do appeal I think they have next to zero chance of succeeding.

Yes Si_D I was reading about that and the very long delays , covid, parts, change of scope & apparently additional work once returned. Would I be correct in assuming Suncour had the final say on TN & it will be Cenovus on SR ?

Each day late is v costly when you consider what they make per day. I wonder if there are penalty clauses attached for slippage on scoped & quoted works, there will always be an element of additional 'discoveries ' requiring resolution.

Anyway looks positive and from what's written looks like 24/7 for faster turnaround.
