Secondly, any opinions on advantages of a delayed or Tax Year split "award" between FY 2022 & 2023 ?

I repeat, Eamonn Ryan will "never ever" sign off on Barryroe, he believes that this energy crisis is exactly the shock to the system that Ireland & the wealthy west, needs to change our wasteful ways. He only spoke 2 days ago, saying that the Irish energy crisis is being hugely exaggerated & that there are no supply problems.

And if these are not the dog days of summer to announce some movement, then it never will be.

And he may be right in his BER : B1 house, but thousands of poor Irish will die in Ireland this winter of hunger & cold.

Why don't we all just invest €300,000 (2010 prices) to better insulate our homes.

I am a novice in these things, but learning the hard way, having been mis-informed early on.

I expect the ECT was the relevant & applicable treaty, the UK was then still in the EU, so that is not the question.

Quick read link on Wiki ECT & near impossible read link on ITALAW - RKH Vs Italian Republic !!!

I also spoke to an arbitrator friend in Geneva, who told me the ECT is not applicable between PVR Vs ROI, its only applies to private investments in a signatory foreign country & intra signatory governments.

There are newer ICSID rules that may become relevant, if signed off by most countries, in 2023 or later, for future cases.

Huge result for Rockhopper, far better than most expected !!!! Well done for sticking it out.

This was a case taken under the Energy Charter Treaty (ECT) & to my understanding would not be directly applicable to an Irish company suing the Irish Republic. Any PVR Vs ROI claim would possibly be under EU laws.

It does however have direct relevance & jurisprudence for EOG and its Inishkea licence, as they are a UK (foreign) company. Hence my new punt on EOG.

I say, any Rockhopper decision has no direct correlation or jurisprudence relating to any PVR Vs Ryan licencing issues.

Now explain to me exactly how any ICISD rules are relevant to any PVR Vs Ryan case ?

Interesting paper, lots of similarities with Ryan Vs PVR, pay attention to page 5, last paragraph, feels very familiar.

However, unsure if the Energy Charter Treaty, only applies to Companies suing against "foreign" signatory Governments.

I am however somewhat surprised that "Market Moving" information is not freely & equally available to all PVR shareholders, even though, with my losses here, I could have paid for hundreds++ of FOI's ;-)

Might that not be just one more reason to sue the Irish Government for its delays ?

I did mention the $34M claimed RKH losses & are suing for up to $340M against the Italian Govt, info gleaned from this very chatroom.

For Info, I never heard of Rockhopper, until it recently became relevant re-PVR share price & all sorts of fantastic ideas & awards being were being proposed on the PVR chat site.

So I took a look and my good friend in Geneva, who has no knowledge of this particular case, is just advising me on generalities, but it's valuable to me nonetheless, as I try to do my homework before I invest, rather than during my losses autopsy.

I have been an 7-8 year looser on PVR, but still have a tinge of hope, for its necessary development & share price jump.

I also invest in GLEN, ANTO, AAL, TUI, IMB, etc, etc, to fair to middling success. A typical cosmopolitan Green Activist !!!

As for taking down governments, thanks for the compliment, but I was shielded from the gamma radiation, so that super power never really took hold :-)

And I mistook nothing about the arbitrators, I tried to learn more, but the ICSID website search, gave me faulty search information.

If I had realised that you were the site Gatekeeper, I would not have asked you a question, SH & SB were kind & most helpful.

She is the Italian governments case counsel, it was a poor & misleading search result from ICSID.

She has a very impressive CV, a formidable adversary & from what I can "understand" from SH's case details link, they seem to object & delay on every possible point of law.

I think I answered my own question for myself, by digging deeper on their site, she is designated as the "Counsel (Resp)" on the case. Not sure yet what exactly that entails.

On some ICSID searches/documents it shows 3 & on others 4. The Italian lady seeks to have disappeared/resigned ?

Might that be a good or a bad omen ?

A friend in arbitration in Geneva, told me today, the election should have no bearing on the award timing, but I doubt that is taking full account of the Real Politik & Italian elections.

I had noted that you are one of the recent worthwhile commentators on both PVR & RKH.

I just contacted a friend in Geneva, who works in international arbitration, to see what he could "guesstimate", for their future pay-out. On a first look, it would seem that the quantum, would depend on multiple applicable laws & precedents, that influence the case. Further research pending.

Its not a typical expropriation case, where the state steals a valuable resource for their own benefit (though they could at a later date) & it may be argued that the Italian Republic is following "COP 22" conventions & newer Italian Laws & carbon reduction limits & other legally binding agreements.

However, that could also be "later day" thinking, as the licence was blocked before 2017.

The ICSID case is linked below, but is not very helpful on fine detail, except that the 4 arbitrators are a German/Irish, a Swiss (Geneva), a French (Geneva) & one Italian lady, that some talking heads accuse of delaying the eventual pay-out.

Can you imagine a quick & large pay-out during the current Italian political crisis & 60 day electoral period.

However, their contact details are all listed, so if Manmentia wants to harass them for 10X or 20X or 30X !!!!

I also note that most "chatting" RKH shareholders are hoping for a 2-4 times the "Rockhopper Italia's" "34$M" loss in compensation, minus a 20-40%, no foal, no fee, legal representation cost & why not, maybe a pleasant +++ surprise.

And yes Menton, can do nothing, while the quantum of Rockhopper is pending, as it will create jurisprudence, for all "effective exploration cancellations" in the EU & more.

I doubt these senior arbitrators will bankrupt countries, trying to back pedal on previously awarded licences.

The RKH share price has has fallen from 10 ish to 7 ish during this "guaranteed award" period & the market cap is now £41M, a very far cry from some of the fantasist football $340M award.

Final question for Wraith,

Do you think PVR & RKH are worth more for their potential legal & financial remedies, that their exploration potential, or maybe what % combination of each ?

The "Business Class, because some pigs are more equal than others", "Multi-Millionaire" Eamonn Ryan was just interviewed on the "This Week" RTE radio program, all talk about agriculture, herd count, anaerobic digesters, etc & not a mention of Barryroe. He easily outdone the presenter, but complete softball stuff from RTE.

Funny again, to see him flogging Irish Offshore Exploration only 15 yrs ago but he seems to be sticking to his guns today on Barryroe.

And nobody has mentioned, that if he ever did OK Barryroe, he would be immediately voted out of leadership by his own Green party members, loose his super important ministerial post & his nemesis "Business Class" Catherine Martin would take over.

But if he delays & obfuscates & the government collapses while not OK'ing Barryroe & that forces an election, he will be right back into the same post with a coalition with SF & assorted loonies.

Total Opposition politics is big business & very profitable.

The fascist Jean Marie Le Pen here in France is worth up to €270 M, more than next Tuesdays EuroMillion :-)

I agree with the logic of you response 100%, Ireland, the EU & Others need to assure their economic, food, energy, oil, gas & electricity, to guarantee essential commerce, food supplies & vulnerable peoples heating during the coming Winter.

However, I completely doubt that Eamon Ryan is the person to enable that, for ideological reasons.

While Ryan's reasoning is potentially right in the long term, with 2-3c temperature rises by 2050 & 20-40% animal & plant extinction and future hurricanes from Gort to Granard, we must deal with the immediate & save lives today.

New technologies might be developed to allow us to continue our wasteful ways, but it would helpful if everybody did their best to reduce their own consumption now

My view is that a FF & FG directed government collapse is the only honest route to a better future.
