Should have also stated that the initial statement for the VAST NOMAD's resignation was dated 16th December 2016. The nomad gave some warning however and was due to resign on Jan 31st. VAST found a replacement and it was announced on 30th Jan 2017.

Not true - this is the story of VAST who lost their NOMAD in 2017.
LONDON (Alliance News) - Vast Resources PLC on Friday said its nominated adviser Strand Hanson Ltd will resign with effect from January 31, 2017. The AIM-listed mining company said it is in "advanced discussions" with a replacement nomad. Should a replacement nomad not be appointed before January 31, Vast Resources' shares will be suspended from trading for up to 30 days pending such appointment, following which, should a replacement nomad not be appointed, its shares will be cancelled. Shares in Vast Resources were trading down 29% at 0.117 pence on Friday following the news.

There’s a thought - even if we lose the default case, we still are sueing Hope for the the $56 million which we will probably then win, which is broadly what the company was worth before all this mess occurred.

Bridget To me it suggests a deal between Hope and FRR where we give up a percentage of FRR’s B12 to hope in exchange for not going bust. The big question is how big the percentage needs to be to make the deal happen GLA

Not the news I was hoping for, with more invested here than most. That said, it saved me from panicked decisions at 8 am. I’m sure we’re all waiting for the knowledgeable posters Mole, Star etc on this site and Symore, Devex etc on ii to post their thoughts. 1 - how likely is an out of court settlement? 2 - if we lose, but have the new loan in place, can we simply pay to avoid default? 3 - what happens if no new nomad is found? Do we effectively become a private company , with us all as shareholders, but in a now very difficult to trade type of way? 4 - is there any recourse if it does all go belly-up? Court action against say the Nomad or others? Thanks all and good luck. We may well need it.

That seems a very balanced response Star. An early wake up call for us all I suspect tomorrow morning. Enjoy your whisky this evening. In my case , I prefer the blended whiskies. I had some Jonny Walker blue label a few years back and enjoyed that a lot. Hope to be able to afford my own bottle soon...

Oh right, of course it’s the reference to the loan agreement for $60 million. I mistakenly thought you were suggesting some sort of agreement with Hope. Thanks By the way, I have just added Spike912 to my filtered list, which I have just counted now has 40 names. Can anyone beat that?

Star - for the likes of me, could you explain what a term sheet is and why this might help. Sorry for not already understanding and many thanks for publishing the docs yesterday and starting at least to level the playing field for shareholders.
