Brainspark and others recently told mid week/this week, but nothing really ever gets met on delivery. Sadly. Maybe tomorrow, but not mid week for sure.

I am getting the feeling that we are about to get disappointed yet again. Certainly timescales are all over the place on a regular basis. Just hope this isn't usual service in line with delayed publication. Need to break the habit of delays and disappointments for once with these (delayed) interims!!

Niptsteve, I suspect after illumina's win we may offer some form of platform transition and clearly that is to tempt illumina to settle and could not then be held against them by eu comm.

Strange Brainspark asking the questions - what about that educated guessing or being told and telling us? ;-) A few things to ponder.... How does our court loss effect recovery of funds from Genoma/Esperite or no impact? Espirite stated they did not have enough support and under pressure (being sued) etc and that we had infringed and would lose . Well, we had and did!! Imv it still doesn't impact on not paying their bills, but the one area that isn't good, is that we lost the patent writ which supports Esperites stated view and s part of their stated rationale . If we had not delayed for a year we might have won back then when things were all going against illumina and the precedents and general view was more in our favour at that time. Since then we had this Julys judgement notaflipper posted and changes in viewpoint that was not about before and imv changed the dynamics. Of course had we lost back then the damage would likely have been terminal as we since diversified geographically - Though STILL not had a new product delivered as part of stated diversification . Just years of talk so far on that and it needs to be damn close now ! If we move onto illumina's platform in UK (eu) for a settlement. How would that work in practice? Labs needing to buy illumina machines and transfer over or ?? Not sure of the practicalities for existing customers in UK /EU with tfo machines. Just thinking out loud Oh btw Brainspark , how are talks with Illumina progressing ? Been told any more educated guesses?? Lol

Illumina would fight, but also mindful of eu commission. Anti-competitive perhaps unless they allow a license. Just make the pips squeak. I hope we offer enough incentive with the eu comm stick in the background. Many strands to draw together in search of a settlement and timing plays a part. Mood music no longer illumina bully boys denying choice for pregnant mums. Rather young upstart circumventing patents and being held to account.

We had the evidence and expert witnesses and the Doc at Hardman was stopped from giving away the details of our defence all in the interests of commercial sensitivity and we had nothing to make an educated guess with except the bods statements to rely on, yet when we shoot for goal we can't hit a barn door. Imv we cannot have been as convinced as we needed to be and that started to become apparent as the bods rhetoric became more mixed verdict than win. All the indicators for me push towards a gamble that spectacularly backfired and/or that we were possibly pushed into by thermo and it seems very disappointing that we didn't (push harder to) settle.

If you remember all along I stated that I didn't much care if the patents were valid or not, just as long as our proud boast often repeated that we did NOT infringe anyway was backed up by the resolute and compelling proof. It was not. Now I know the answer to this is that in a court of law its never that simple or straightforward and also open to interpretations blah blah. Well then, if we were not sure we could prove our claim because it might not be convincing enough, we should have settled . the downside not to settle then becomes too great and its a gamble. We gambled imv and lost because we DiD infringe. We clearly stated we did not and we failed to prove it satisfactorily. Lots of grey, but in black and white if we had a clear enough and compelling position we could not have lost. I rather took our bod at their word with evidence to prove it beyond a reasonable doubt.

As I said I believe there were indications we had negs that looked briefly like we may settle at one point and reading between the lines as the court date approached. It may well have been unpalitable and not to thermo liking, but whatever was possible then is a pipe dream now. I think there was opportunity but we played our hand and that's my reading of the indirect indications and our flawed view and just about all of our expectations, as it turned out.

Steve67, Also stated UK related in our own rns. I assume as high court ruling has jurisdiction over UK rather than over UK and EU. Though seperately filed patents valid in both and precedent set. Brainspark. Better days start this week. Good news today but today's SP unchanged and no better. We really screwed up in insisting we did not infringe and going all the way without settling to be left that almost the only news that now matters is the fallout and/or resolution to this legal mess. Try that next time you are told news or make a prediction. Lol

anything back yet. Market flicking the fingers back - waiting to see if we have an EU business if we don't agree a settlement and a bit early for details on injunctive relief. I expect we'll get some form of settlement with Illumina in the new year and it will be painfull but the right decision. Good news today but as I expected little reaction and currently may as well have said nowt. Only things will move us materially are a writ settlement with Illumina or meanwhile a massive contract outside UK/EU or new product announcement - probably also when b/e announced. Otherwise contracts in UK/EU are seen in a worst case scenario as almost worthless to our share price whilst verdict remains without any settlement. aimho

This for providing something to hang a hat on Brsinspark. So, taking that at face value I would assume the following .... Tomorrow's news will probably be a contract or something small to medium, but not going to have a lasting effect on SP. After all the bod will be buying after Wednesdays results. Said they would be this week Hemo. Lol Illumina talks.... let's be realistic rather than follow the well worn path of missed expectations. If a settlement comes it will be Jan 2018 at the earliest. Oh yer, but it could be anytime/tomorrow. NO it could not!!

just hope this time it turns out to be correct Brainspark. Interims this week, so imagine that will be the catalyst for better days. Probably just as well you didn't tell or hint (if you know?) as it's become a stale joke now, that delivery is a shadow of what's told expected. I'll be pleased this week if they can match the talk to the walk for a change.
