I think most of have concluded the likelihood What we need is a settlement and I still have hope for that . if delivered I think this issue will disappear into the long grass

I see Brainspark is still on repeat behaviour. He's been let down again and is venting. However, i do believe his TF claim as I am as sure as I can be that we had a chance to settle before court hearing. This doesn't reflect well

I would agree, but,...... If we offer s more than fair settlement package as we surely must if pushed and illumina reject it, then how would that look to eu comm? Surely its in illumina's interest also to show they are not being anti-competitive and otherwise counter productive to play hard ball to the point where we go back to eu comm and say just look at this for all the proof you need. We need to take some pain and I hope we are prepared to give enough to otherwise scare illumina into fearing the eu comm. It depends if we can do a better job than we gave managed to date. Aimho

Oh dear! Even Brainspark is having a wobble and losing faith. What you get told gas to be taken as hope and more often than not it doesn't happen and those pesky expectations are missed again. I still have hope we can get a settlement but track record is just so unreliable.

Any leverage should have been used in their negs and prior to this announcement, so lets hope it was and in which case any settlement news should follow shortly. One hopes.

Reading the rationale I agree with the judgement on balance and taking into account the changing landscape of other judgement handed down in July that flipper provided. Illumina defended their valid patent and although there is always room for doubt and interpretations we gambled to the end on a mixed verdict and got nothing ! Nothing!!!! I don't think any fix was in. The risks were there and underplayed or not fully appreciated. After the early rhetoric. Costs. Time taken. Damage done. Funding required and our share price to have been comprehensively thrashed deserves some impact on management and their options. Tough new KPI's that reduce future milking profits, having screwed up so badly.

I mentioned I had had a couple of indicators that told me on the balance of probabilities/reading between the lines, so I am convinced the opportuinity existed shortly before the court case started and that it was being considered. I do not know absolutely, but I strongly suspect this. aimho

We have had a good product and revenue, yet due to writ and decisions/consequences, a story to tell that rivals the worst of Vialogy in practice that mirrors the disappointment and share price history. Incredible really!

No idea. I am sure it would have been unpalitable, but nothing like losing. I think many (vialogy) shareholders have had 50p in mind on a buyout as a minimum - being the options price - and if averaging down have that as a safe target to claw back to b/e. Long gone are the days of a pound or more and now 50p may very well not be realistic. Once golden prospects have diminished and its long overdue that the trend reverses.

I suspect that's correct up until shortly before case started when we could have settled and should have done. Aimho I think we can tell from the delay we took to partner and to diversify geographically and the taming down of the rhetoric to mixed verdict as case approached, that we didn't have the strength of case we publicly stated. So very predictable that Brainspark has done a carbon copy of the last time great news was due and failed. A runner! This time telling us better days started from the 4 eu lab rns with interims mid Dec and director buys to follow . then to completely disappear when it all falls down! Anyone can be repeatedly wrong, but first ignoring it and then disappearing afterwards is poor and seems to happen all too regularly! Here is a tip. Don't take the educational guesses to the bank. Banks these days cannot be banked on and you really should have learnt that by now from experience.

Illumina have not put a foot wrong and Dr Little looks like a real chump 2 long and weary years later. I agree with flipper, that those brave enough should average down. It's another buying opp!

I suspect illumina have not and will not do so in eu until after the eu comm report . nothing wrong to defend their eu patents as I agree , now they have won in court, that is all they are seen to be doing and frankly well done illumina, but I don't think they will want to rattle the eu cage at this stage before the commission reports and expect that is why its not been done, but to let UK high court play out the battle.
