I don't think it would hinder the price either at that time because we would already be and remain very low having lost appeal. Your previous point was all we had to do was wait 10 months for all to be good and well with the SP. Clearly my point remains that that is just not true if we lose appeal, even if SL was telling the truth and he's got nothing else right wrt litigation so far! It remains naive to assert that waiting 10 months is the worst case downside. It is the best case.

To Sue them starting from appeal lose would leave us way over your 10 months waiting as a worst outcome, which was the crux of your point and the core of my rebuttal was this timing aspect and its a best case/last hope in this regard if we lost appeal as well.

I think it's fair to say none of us has s scoobie about status and timing of settlement negs. I do think it may be more urgent to us than to the bod and I am losing faith in the the bod to get anything right wrt illumina and the litigation.

No idea how long until we hear on 321. U had assumed (probably incorrectly) that the judge had been deliberating and would rule first instance judgement this month. Hence I was not thinking in terms of a settlement taking until July or later. However, I can only say it seems to me yet another case of not imminent and how long is a piece of string. We are forever waiting for delays!

Mainly the timing , but learnt to take nothing for granted after many delays and disappointments. Let's see what the 321 hearing delivers.

I agree niptsteve, I still don't see an imminent settlement and quite likely not in March either. Illumina are probably stringing us along. Been a masterclass from illumina. Just have to see how developments on 321 effects the balance of play as I cannot see a settlement beforehand.

I am actually quite hopeful for a settlement and not for any worst case scenario and I have said I can see 50p as a real possibility after a settlement, newsflow b/e, new product and TO, but if we do not settle and lose appeal its a brave man who says the worst case is only waiting those 10 months. We win even if we lose. If we lose appeal as well then at that point don't be surprised to be surprised Florida just like the writ experience all along and the export issue you have trouble with. You cannot factor in all the possibilities or future developments that whilst not effecting our rest of world business directly would still impact our market value. I may agree with you on balance of likelyhood today though i pray we settle, but i do disagree with your presentation of a worst case of just waiting 10 months come what may. Aimho

That's an expensive solution to set up a new lab - more funding and just how does it change anything? We cannot export to Macao or this new lab you want to set up for the same reasons. Its not Macao specific . All I am saying is experience has shown that it is complacent to think there is no risk especially where illumina have shown us how to play the game to date. There will be scenarios where this pain can be worse or prolonged against expected 10 months no matter how remote they appear now or how good our rest of world business is and you are unable even to satisfactorily answer the intl lab issue let alone future developments. I am simply saying that your view is complacent and we need to settle . aimho

Hemo, Yes, illumina won and hold the cards. That doesn't mean we should not try for a private settlement as imv there is a chance that what could be offered is better for both parties than a judge has scope to impose. I am pretty sure a platform change in uk is one such incentive. If not then we let the judge decide. That is all I have been saying.

Re taking measures wrt using Manchester as an intl hub. The measures were to export analysis to Macao. Thus was not granted by judge as it stands. You have more faith than I do on bods abilities looking at this whole writ issue , outcome and misjudgement to date. We expected a win or to export to Macao and totally lost. What other measure is practical if we go to appeal and lose again??? Name one??? Appropriate measures accordingly tells me it's clearly not a sure thing in 10 months .Lola

Think of it this way. If we gave up UK and Europe we would still have a good business, but we would not give up Europe we would fight any writ there too in the first instance rather than just roll over immediately. Hence without a comprehensive settlement we have years more legal battles and costs with a depressed share price. Thus is not my prediction at all, but simply to counter your point that there is no down side if we just wait 20 months. Florida, How would you expect the share price to react in 10 months if after the UK appeal is lost or in the meantime illumina sue us in eu and first hearing is scheduled for late 2019/ early 2020. My point is there are many permutations of outcomes and we have completely ballsed it up once already where nobody predicted half the float price was even conceivable. IF it was only as you describe and no other possibilities then you would be right. I don't subscribe to a future without bumps in the road because it is a very bumpy road where expectations (as you display) are frequently blown off course by unpredictable events.

This never plays out risk free and the ramifications of losing again on appeal somehow being just the loss of less than 10% (UK) with illumina playing nice on eu patents and our intl processing lab in UK and unable to export for analysis. I am sorry, but I have read throughout so much complacency wrt writ and ramifications and no or limited downside.

Firstly you don't know that Florida. We could lose the appeal and then gave illumina start litigation in eu and drag that on for 2 years subject to eu comm outcome. There are a myriad of unknowns which a comprehensive settlement should include to draw a final end. No other remedy guarantees this (for eu). Then if we lost again illumina would press home that we cannot export to Macao under current judgement and we have a lab in Manchester I.e UK. Follow the dots and join them all up..... I think there has always been a lot of wishfull thinking around the writ issue and that continues. We need to settle and thst means settle all outstanding writs for all geographical areas and all related issues to get full closure. Imv the 10 month wait with no other problems is ridiculous.

Hemo, Of course the bod are right to pursue a private settlement that could be better than the judge would impose. The judge would not have in his remit an offer to change platform in UK and possibly Europe too. as many think tfo have given the nod to and we can structure a completely different deal with different incentives that the judge is in no position to rule on. Possibly even some form of partnership in (other) areas of (future) development etc. The options and scope in a private settlement are way beyond the more narrow confines of what a judge would order and give much wider scope for a private settlement if it can be agreed ! If not then imv we can refer back to the judge by end q1 without waiting anything like a year and with the added incentives to show we sincerely tried to settle in good faith and also relay that to eu comm. We should first try to negotiate with illumina because there should be a very REAL chance of formulating an acceptable package to settle that the judge would never construct. Jeez!!

Had I had the energy to repeat - as i said previously that no judge would rule whilst we have a right to first exercise an appeal as you reiterate. I would make all the same basic points notaflipper with supplemental that the form of order hearing outcome also adds to the view to pursue a private settlement in the first instance. We shall see. Not sold any . just a bored LTH whose weary of missed promise, elastic timeframes and non delivery, though as I mentioned, your thinking duplicates my own where i expect bod hope to settle first, whilst holding back news meanwhile where possible.
