We need to settle with illumina and move on! Shares in issue 321,218,279 Add in all the warrants and options for fully diluted basis and that becomes 458,721,071!!!! of which the 95,688,706 is 21%, well good as at 20.86%.

Illumina were interested, as many of us believe there was s settlement possible which tfo blocked. So try again. It's also imv common sense because if illumina turn down a very good settlement deal we will make it clear to eu comm and that is exactly what they are investigating being a top tier example of anti competitive behaviour. If Refused a license fee when also offered a platform change , illumina may as well raise the white flag to the eu comm . imv after the form of order hearing it is in both parties interest to get the best deal they can and settle. It has been stated that the judge has the power to enforce a settlement. I suspect he did not because we have first, a right to appeal which we sought. If we are not appealing because illumina are not interested in anything but an anti competitive slaughter of competition, then we deliver the evidence to the judge and ask him to rule. All that is then left is a judgement - ruling from the judge. Aimho and forgive me but it seems quite obvious if we cannot get s settlement and as opposed to playing illumina's game or appealing and waiting a year to lose again. Btw, I was the closest poster to rightly inject some caution when others seemed to think we had it in the bag huh bakky. Lol it was clear we had delayed to mitigate a conceivable loss and backtracked on rhetoric so premaitha knew it was reliant on interpretations and expert advice/witnesses and it turned out dismal for ours. Supplemental. The judge has given us an indication (10%) on his thinking. We need to expedite a settlement with other factors admittedly included in analysis like 321 hearing, eu comm, eu free from future litigation. Etc

Disagree , we are then probably better off not appealing and having the judge enforce a settlement imv Let's face it in all probability we otherwise wait over a year and lose again with all the costs and a worse final outcome. At each stage (pre July case where we had a settlement blocked by tfo) and now. At each next stage we get worse and worse terms and our business is in limbo with customers put off etc as we wait years. Enough !!

When a share price sinks so low, unless it's going bust, we should rate as a buy down here, just as tw has stated many many times all the way down from 30's to half the float price! So far tw has been a very reliable contra-indicator, though probably right this time, as any stopped clock .lol I am waiting for something that effects the share price to finally go right/as expected. 50p - we will get there when the list I gave is completed. Need a settlement with illumina as the catalyst though. I have little doubt the fundamentals and newsflow would make 50p still achievable for a TO. Seems quite attainable after settlement, into profit, new contracts, new product etc. We all know how quickly news and sentiment can change eh Brainspark. Lol

I would hope we have already been exploring for commercial partners in advance of this news, requiring a short delay rather than what has sometimes been a long waiting period to find and negotiate commercial partnerships.
