As I have said before I was surprised when DAERA conceded the permission stage but did not concede the JR. With today's judgement I think DAERA have been proved right in their approach. One of the grounds was whether the decision should have gone to the Executive for decision. Now DAERA can use this decision which is admittedly persuasive to argue against going to the Executive when there are controversial proposals.

AimHigherStill ref 11.9 post at this stage it is impossible to answer your question. HARL are likely to be able to get funding from both the UK and if they can get their fingers out the NI government. Without knowing how much state funding is available it is impossible to say how much extra if any needs to be raised.

I note this from the judgement 'The Company will now assess this judgement in detail and consider the appropriate next steps factoring in the findings of the judgement and the interests of Harland & Wolff's stakeholders.'

Presume we will hear something next week after they have read the judgement.

SYN00GOLD ref 10.23 post I would beg to differ while No Gas Caverns can appeal the question is can they afford to appeal. If they were to apply for leave to appeal on a subject like this they might get leave.

Is the judge reading the whole judgement or just giving a summary can anyone tell.

Just seen this on the BBC website https://www.bbc.co.uk/news/uk-politics-66667039. I would favour Janes Heappey as he like Ben Wallace is likely to less forgiving of prime contractors who fail to deliver on contracts. Interesting side note Heappey actually outranks Wallace.

Bubble2021 ref 15.59 post judgement is tomorrow due to the time judgement is given we might not get any RNS until end of trading or Friday.

This seems a rehash of one of their grounds of challenge that the Minister disregarded the views of the marine task force and indeed one of his advisers. This is what I meant by a merits challenge. All the minister needs to show is that those views were taken into account. The weight that was applied to those views is for the minister.

MaryBri90 ref 13.04 post I am not sure that JW has seen the draft judgement. The reason for saying that is the Interested Party is IslandMagee Energy Limited. As they are the lay client Judith Tweed who is the Director and would be the first person to give a response she would be entitled to a copy BUT JW who is not technically a party is not.

MaryBri190 ref 12.55 yes but few of the two dozen would risk the consequences which could include if caught fines, imprisonment , disciplinary proceedings, end of career or the sack. If they are lucky they might get away with a grovelling apology. But no MI5 investigation as they do not investigate contempt of court.

I presume that they would have to agree to use Arnish and Methil to build the ferries although the Scottish Executive does not seem too keen on using Scottish yards themselves.

A bold move by JW if he can pull it off. As I understand it HARL would be going up against a potential customer. While their is levelling up funding for new ferries it is not for HARL's plan so I do not see how you can get funding from the same pot for two competing ventures. I presume that the local council will ask that the HARL plan be considered instead of the current one. Interesting to see how this plays out.

TheEast ref 06.28 post I am not disagreeing with anything you say. In my view the unknown that may affect the SP is the market view of the construction period of the caverns. I have built this in to am extent in coming to a forty year asset life. But the market might worry about how HARL will get to the operational stage.

I am getting very concerned that we are in danger of getting a repeat of the FSS contract decision. Some on this board seem to think that if there is a positive result the share price might suddenly jump to what most of us think is nearer true value. I agree that is possible I am just not sure that is what is going to happen. We all thought the same would happen when the FSS contracts were awarded.

The issue is that the market may not take the same view as shareholders do. I suspect that unless we get the FID at the same time as the JR decision we may need to wait for the FID. My reason for saying that is with the FID we will get a more accurate figure for the value of IM.
