That is not the case having checked High Court Judges and above can only be removed after an investigation by a tribunal which does not contain any politicians. It is even harder in England and Wales there it requires a joint address from both Houses of Parliament to the King.

I assume when you say JV you actually mean JR as a JV does not make sense. Judges contrary to what some people think do not generally make decisions on political grounds and I would expect the decision to be made on normal judicial review and public law grounds. They will not simply do what the government say.

Davidbarnes66vir ref 19.49 post you appear to be comparing a drug trial with a judicial review. The two are not similar. Your reference to Synairgen is misplaced as that was a drug trial and likelihood of success cannot be calculated in the same way. Judicial Review is a two stage process. If I recall correctly the 13% is from all cases that went through to a hearing (stage two). To get pass stage 1 the permission stage the claim has to merely be arguable.

I accept that it is possible that the IM judicial review could be in the 13%, However, from the Northern Ireland Audit Office report the possibility of the DAERA prevailing is greater than the possibility of the claimants succeeding.

Dancer123 ref 17.32 post May I suggest reading some of the back in particular those that relate to financing. HARL are in the process of refinancing its debt with a £200m financing with guarantees being provided by UKEF. This financing depending the scheme used might also help with cashflow.

Scaffman ref 12.24 post the article states that RWE owns six sites with a total of 2.7bn cube so IM is of a similar size of one of the sites.

LSE03 re 25 Aug 2023 21:48 post The size and number of caverns seem to be about the same size as IM which gives a value for a fully operational facility at IM. It would also seem to validate the suggested current value of IM. As I have argued before from this you can get a value for HARL as a whole. If we say that undeveloped IM is worth two thirds of the value of the RWE Facility converted from EURO to GBP gives a value of circa 170m for IM alone. So a rerate is long overdue. Lottie123 what would be the affect on the NAV for HARL.

I think part of the reason for the low success rate is that some people do not appreciate the difference between a merits challenge and a reasons challenge. In Judicial Review a merits challenge is not allowed a challenge is normally only allowed on the basis of failure to give reasons. The only other reasons are that the decision maker acted ultra vires or acted unreasonably. Unreasonable in this context is not the same as in ordinary language.

Si_Derman ref 18.47 post apart from those on the restricted circulation list for the draft judgement which may not include JW but probably would include Judith Tweed and the Judge's clerk nobody will find out before 9.30 on Thursday. The penalty for leaking can go anywhere from a warning from the judge to two years in prison. It depends on whether it was a deliberate leak or an accident or thoughtlessness.

Two pointers first, I was at an event and I started to ask about the Deepwater Terminal and was immediately shut down by JW who was not going to discuss the matter. Second at another event if I recall correctly JW made a comment about working with others to make an offering. With the new terminal you have a place to manufacture the turbines and a clear route to get them to the site.

Good News and Bad News Good News is that the lawyers on both sides are likely to have received the draft Judgement under embargo today. Bad news is that it is a tight circulation and severe consequences for leaking so there is unlikely to be any leaks.
