Ears,its not the judges job to determine if Frr can afford counsel .they obviously have an issue with terms and are standing down ,whether it be financial or strategic..they also jointly came to the conclusion that dismissal without prejudice was best option.judge will await Frr next consel within 30 days.its up to Frr to decide if they can afford new consel or not Imo

Phil.you could also say Frr would have been in a much stronger position if they hadn't defaulted .any monster deal or loan could have been sorted.fact is zz could have completed his loan to Frr .all he needed to do was accept that omf was senior to it ,which would have been fair enough.
It is hard to imagine anybody lending cash or buying Frr until all the added complications of the last 10 months are sorted .

Time will tell. I think it will get to the point where they will struggle to get representation.I expect this case to get dropped with prejudice but we all can read it differently.

Free,whilst in lengthy discussion on terms.(payment) it was agreed to take the approach of case dismissal.having already been caught once this way there is no way hope will agree to dismissal without prejudice.frr brought this case .if they want out they will have to pick up the tab again and with prejudice.lets see if they accept with prejudice.

They've been talking about terms and the decision to go for dismissal was arrived.so sounds very much like they are not paid up to date and Frr cannot afford to proceed or have been advised it's a waste of time and money.This is going the same way as the Cayman case except hope won't wear without prejudice again. hope seeking discovery .seems like Frr only enter into cases they cannot win. No doubt it's all part of a cunning plan.whats Georgian for turnips ?

Agreed star rage.if you promote the idea that enough cash is going in to pay debts from production,why would you add huge extra costs of liquidators and court costs into the equation.doesnt add up.As you point out zz sn now have hefty personal liabilities with the likelihood of costs on top.personal asset switches to family members on the cards I would say.

Exactly Phil,so this notion that it is costly to outrider for the liquidators costs is nonsense.The liquidators costs come from the company being liquidated.

Cf,,it is the liquidators ,not hope providing this information.under court supervision I would imagine that the hideaways would be in contempt of court if they carry on their evasiveness.It is obvious that the liquidators are wanting to investigate the asset movement ( farm out ).

Calibre pointed to high grade deposits in their original presentation.of course they will have had a good look at the data.certain posters on here were saying that their deal was too expensive and wouldn't complete and loss making mines etc.they have spent less than our mine build .i know which would be easier to fund and the better deal.as always dyor . As you say el ,still need a definitive plan for Cnr .m c stated banks were queing up to fund mine build.

Sounds as credible as no word for 10 months to share holders but telling an interviewer Frr de listed deliberately..They are not people that honour their word so anything is possible imo.

I wait to see if anything can progress with calibre.it will if it makes sense for them.Not given up hope.b2 is a 30 per cent holder with a seat on the board so if it made sense before the sale it may well do now.The rising gold price and expected cost reductions may make it less appealing.more patience needed.

Ha,dukey.how you doing.well you had a nice little ride last time we hit these levels.I am more caurious these days.still in and traded a decent average but still a long way to go imo.I am spread over a number of goodies and had a good 9 months in producers and treading water here .lets hope gold carries on north.I reckon there is financial chaos approaching.

Tester,calibre looking at 130 k pa I think so even better economics.only a little while ago it was being sugested on here that calibre wouldn't pull the deal off or that they had overpayed for a loss making mine. 130k oz x $500 sounds like a very good bit of business to me . They are in a hurry so we may figure in their plans at some point.They obviously still have spare capacity if they have laid up a ball mill.
I agree with e lion,the rise in gold price makes a toll deal less attractive to them.There is still a lot to be done before any income imo.more patience needed .

oxus arbitration was final and did not end well.I think the arbitration has the possibility to make the other cases irrelevant.hope not but when things are viewed in a legal way,not honouring contracts and agreements rarely is seen in a good light. Here's hoping the arbitration does end in a compromise .
