Think it's in best interests of Samsung and nano for a quick out of court settlement. No doubt both in communication (via Mintz) and damages will have to be huge compared to nano Mrkt Cap (just short of £30m now), I guess minimum of £300m, which should increase Sp by a factor of 10 (less expenses for Mintz and financer).
Don't know anything about company law, but imagine receiving stolen goods (or IP, let alone giving it away to Hansol and or Chinese) will probably be worse for Samsung than simply stealing it.
Simple idea is that if Samsung Tv's use nano CFQD's they are guilty, cos they have no patent (regardless of collaboration), and, if they gave that know how away to a new supplier, that is a second offence ie 3* for orig offence + maybe same again for 2nd offence. Samsung cannot let this happen.
Looks like new contracts possibly on the way, so nano could maybe wait for the Court case without going broke, and even if they go broke IP will be up for sale anyway, but since finance will shortly exist for the Court case and experts (Mintz) already in place, it will happen whatever.
Worst possible case, nano goes bust, but court case still goes ahead. The Liquidators have to pay off Tax, Vat first then Banks and any other debts, the remainder is paid to share holders (less Liquidators fees). Should leave plenty, however you look at it.
