Mayana , we can tell by the inf mcadder kindly provided that the application was made prior to the 4th of June. If Stokey12 is correct ( results known to company , prior to handing down on Monday) the timings are very tight . The company would need to have been informed prior to the 4th of June and then managed to get hearing booked rapidly. Great to see it happening but dubious it is based on any known result.

Maybe the 5mm was a suggestion by the judge because the claiments had offered to settle with this exact package much earlier in negotiations. Because Novacyt had declined and the judge gave an indication she believed it was acceptable Novacyt had a wake up call as to of her line of thought. It is not any proof of faulty tests .. it is a slap on the wrist for wasting court and govt time.

Perhaps this package ( minus 5mm) was on the table 2 years ago.

Mullis took the decision to buy in tons of stock and to supply whilst invoices remained unpaid.

Let's not forget that the unpaid invoices only cost Novacyt about a quarter of their value. It was the stock we had to dispose of and the ongoing saga as no compromise reached that cost the company substantially more.

Even a receipt of 5 million would have been more palatable. I don't think any invoices will be paid, there is a net 5mm pyt. That is not what I call a very strong case.

The positives are , we survive, we are in a substantially better place than prior to covid , both with cash in the bank and the acquisition of Yourgene ,with potential for rapid growth.
