"The Contract is for an initial period of six months. After the initial six months, the Contract will continue automatically unless it is terminated in accordance with clause 12"
Very restrictive, no one off business orders then to allow for evaluation?
"The images of the Goods on our website are for illustrative purposes only. The Goods you receive and their packaging may vary from those images. We do not commit to supplying you with Goods from a specific manufacturer or brand owner. Our only commitment is to supply you with a COVID-19 test."
So they're advertising a test, but it might not be the one you receive, but you'll get a covid test. Hopefully if ordering an antigen test, you won't be send an antibody test... Imagine if I went down the lexus dealer and ordered an RX, but they delivered a Dacia Sandero because their small print says they'll 'deliver a car'. And according to their refund policy, only non fulfilled orders and faulty tests can be refunded. So you're trapped in a 6 month order for a test you don't want. Good luck refusing delivery of an inferior test because:
If you fail to accept delivery of the Goods then, except where such failure or delay
is caused by an Event Outside Our Control or our failure to comply with our obligations under the Contact, we may, at our option:
(a) charge you for all costs and expenses related to storage and re-delivery of the Goods;
and/or
(b) dispose of part or all of the Goods and charge the Customer for any costs of disposal.
I highly doubt this contract was written by a legal team versed in sales of medical equipment or supplies. It would look poor on some eBay shops, maybe that's where it was copied from.
I particularly like their get out clause of a pandemic if they're unable to fulfill contractual terms.
Their consumer terms read as though someone just deleted a few paragraphs and added a section about consumer law, eg section 8 waffles on about deducting money for breaking the contract. Presumably if customer agrees to buy a test, chooses to pay by bank transfer and hasn't done it, yet in another term the contract isn't formed until they've received payment!
I've already had my reservations about the fake ISO 27001 claims with their partner company Saturn, this makes them me even less confident in them.
I only have 1 question for Al, when are you ditching medusa, and teaming up with someone like Lloyds, boots, even Amazon or supermarkets if the intention is to sell to individuals. This has the potential to be the biggest covid related stock out there, and will really put avacta in the radar if the big pharma's, so I really don't understand why they've aimed so low with these guys.
