Parkez if AI below is correct you can see why all the secrecy and delays in releasing products. I'd guess they're hopeful the patents will be granted in 2026 as indicated in the smt availability linkedin update.
Not sure what that means for the October headphone release regarding products but it may well be one of the existing devices with a plan to use the new patents when they are granted.

Yes, you can sell products after a patent application is published, but you can't take legal action against infringers until the patent is officially granted. Publishing a patent application can actually be risky, as it may prevent you from getting a broad patent if your own public disclosure happened before you filed for the patent, or it may expose your invention to competitors.
Before the patent is granted
You can sell the product: You can start selling your invention as soon as you file a patent application, including the publication date.
You cannot stop others from selling: However, because the patent is not yet granted, you cannot stop others from selling or using the invention in court. If you sell the product yourself, be aware that you may not be able to get a patent on it if someone else comes up with the same idea later.
Risk of invalidating your patent: A key requirement for a patent is that the invention must be novel and not previously known or publicly available. If you disclose or sell your product before filing a patent application, you may destroy the "novelty" of your invention and prevent yourself from obtaining a patent.
After the patent is granted
You have exclusive rights: Once the patent is granted, you have the exclusive right to prevent others from making, using, importing, or selling the invention without your permission.
You can take legal action: You can now take legal action against anyone who infringes on your patent.
Geographical limitations: A patent is only valid in the country where it was granted. If you want to protect your invention in other countries, you will need to apply for patents in each country separately.
