I had a 'quick' look at 2 cases mentioned by 'deckchair', Conocophillips v Venezuela, and Cairns v India. Both had differing 'problems' CP was a nationalisation of CP assets in V. Expropriation of same. Settled in £013, and 11 years later, V just appealed the decision. Says it all really. C v I is a retrospective tax against the plaintiff, of $millions. Fairly easy to adjudicate on methinks. I would suggest the other cited cases are probably, 'more of the same'. In the case of EML it is not expropriation or tax. A certificate, necessary for the operation to continue, has not been awarded, and apparently, the means to advance the 'award' has been terminated. That does appear to go against the 'principles' of BIT agreement. Ee now have the long wait to see if a prosecution is to happen, and then see what the arguments on both sides are, I think saying 2026 was a timescale for resolution, one way or t'other, was overly optimistic. I still believe that The Kingdoms lawyers would have expected litigation from EML, and must be reasonably happy with their position, If not, expect a 'change of heart' over he coming month or so. I think 'lack of water' is still the overriding problem for EML, and their 'fixes' to date has not ameliorated those concerns. However, to stop any further 'fixes' to the problem, does smell of corruption somewhere in the pipeline. It cannot, I would suggest M'lord', be considered expropriation of the asset, since if a n other party, eventually gains control of said asset, and enters a solution to 'problems', then that is perfectly legal. What would need to be proven is that EML was not capable of entering a 'solution' Going to be a looong time methinks.

I am not a 'chartist', but disagree that charts are a ' nonsense', to quote a few posters on here. Charting for fledgling AIM cos, with no, or little income, no profit, such as QED, is a 'nonsense', but for mature cos, typically those in FTSE 350, charts can, and do show, some good 'buy/sell/hold' parameters.

I do not agree that Arbitrator would take into account the loss of 'expected NPV'. This would imply that the Co has the expertise to accomplish this, and the reason that it is in Court seems to undermine that argument. Costs to date plus damages seems a fair recipe. The KMP process would not be part of the Litigation, and if it has value, will be either sold or used in another venture. A Red Herring. If some on here are thinking of an award, in a a successful case, of 1/3, 1/4 NPV8, ie;$5,6,700Million, stop taking whatever you are on. Not going to happen. Wish it would. But, for those of that persuasion, with a risk:reward of 1:100, you should be piling in. That kind of return will make some investors millionaires, and the Arbitrator will not do that. The biggest reward may come in the form of Punitive Damages, awarded in the case of malfeasance, by the Defendant, and designed to deter the Defendant from any such future actions. It is a Govt Dept that is the defendant, with budgets not extending to those of Public Listed Companies, so I believe the award would be a few tens of millions, if criminal activity occurred, not 100s of millions. All IMHO of course.

Yes, Bod Runcie, it will ( hopefully) be higher in 12 months, in the mean time, a RNS, good one, will see a 10,15% rise, and then a steady decline over the next few weeks, 'till the next RNS. As I forecast the decline in my post of 26Nov. If this happens 2, 3 x per year, and 10% rise is made on each one, that 30% ( compounded) over the period, Will beat the YOY sp. A 2% spread in not big-ish. I do not 'check the sp multiple times a day', please donot 'make things up' to suit your argument. Stick with facts. And 'day trading' does not literally mean a trade every day. It means sell/buy of a particular share at certain 'event', normally a RNS. the major item on that list is ppe, at £35m, and all of that may be recoverable by co in any event, which would reduce sp to;

then there is damages. damages for loss of reputation not always allowed. unsure of this arbitrators award protocol.

punitive damages. when there is malfeasance on behalf of defendant. this is certainly, it appears, a part of the case which may be brought by eml. can be considerable, but unlikely to exceed cos mc.

i'm not sure if this arbitrator awards costs for legal expenses. in uk eg, the failed party may be held for all victors costs, in usa, in any result, each party pays it;s own. so, no idea,

if i had to make a swag, it would be 5p ps in event of a win. , or c£55m. which is a very decent return on todays sp, but it is a gamble.

it will also take some considerable time to conclude if parties decide litigation as the only route. i still maintain 2026 as best date for resolution. let us hope sanity will prevail before then. £55m is not 'bank breaking' cash for ocp, obviously paid through 'correct' channels.

This is not how DMG works, the main product of DMG, with any plastic feedstock or tyres, is Syngas. Is now and forever has been. At Protos (lol), where the plan was to have a H2 refuelling station (lol), the plant needed a 'bolt on' facility to produce the H2 from Syngas. That is why now the MO of the company is to License the plant to produce Syngas, and the customer can use this gas in any way it deems fit. Simple really.

We all hope that common sense will prevail before the parties agree to disagree and go to litigation. For reasons explained before, I think a win for us at Court should be a cash settlement on 'costs to date' plus interest, plus damages. I would prefer the cash, rather than trust this lot again, in any other mining operation, anywhere on this Planet or any another.

Khorud. Classic 'cautionary' words for investing in AIM market. However, I would point out, that many, including one hopes, the PDMR's at EQT, believe this should not be a 'high risk' investment. It has a proven technology in the 'safe' removal of biomass from areas, industries, where, otherwise, it would have been burned. There is also the distinct possibility of using their pyrolysis technology in converting Biomass to Sustainable Aviation Fuel, (SAF), which Woldwide, is a multi Billion $ market. What most investors criticise, is not the technology, but the apparent disregard at senior PDMR level, of 'setting targets, achieving those targets, and reposting on same'.

Divvyup, you have given the excellent reason why PHE, at present, is on the 'waste plastic to Syngas' train. It has a multitude of different product markets to aim for. I say at present, because I believe there is a very good case to be made for 'owner operated' DMG plants by PHE, especially in the vast SAF market, Worldwide. The failure of the recent Global Plastic Initiative, resolution being vetoed by the oil producing countries, shows the problem that 'green and environmentalist' brigades have in achieving goals. I think the debate, with a littler merit, that GW is a natural phenomena, is still a Red Herring, since it is incontrovertible that C emissions in the atmosphere have increased in 'Industrial' times, and that the air we breathe contains damaging amounts of toxic gases and Cancer inducing particulate matter, especially from ICE using FF's. C emissions should be reduced on this fact alone.

DMG offers, as soon will be proven, ( fingers crossed), offers a cost effective way to help in removing waste plastic from the environment, and producing a multi use product in Syngas. Not forgetting 'end of life' tyres as another feedstock, at present, burned in mountains of tyres in India with copious amounts of carcinogenic material spewed out, to name but one. It is the 'done thing'. The MO of any CEO, and other senior executives, employed in AIM quoted cos, is to ensure a financial legacy for themselves and family., by way of salary, pension pot payment at max for age, and share awards. If the company succeeds, it is a bonus, and further enriches them. It is common, that the cos that do not fare well on AIM, (most of them,) still pay similar salaries as the ones that are highly profitable. In our case, the BOD have taken 'cash pay cuts' to preserve cash in these near fatal times for the Company. A necessity rather than being altruistic. If EML 'win' the case, and the EIA application allowed to proceed, I can't envisage the 'losers', The King and his Govt, giving EML an 'easy legal' ride to operation. It will attempt to legally thwart it at every opportunity. IMHO. Be wary of a scorned power base. Memory has not served crude well. Yes indeed, you hit the nail on the head. 'high risk, high reward', the objective of the CEO remains as I described, and I also stated 'if the co. does well, that is a bonus'. Over 70% of AIM cos have gone 'to the wall' since AIM inception. Of course there are some decent profitable cos,. but those are severely outweighed by those that are not. The CEO of these failures, will still enjoy the salary levels, perks, pension pot payment of the successes.

The objective of any CEO, especially on AIM, is to secure the financial future of themselves and family. This is achieved by salary, and pension payments at max for age, plus AVC's, all paid by the company. Exaggerating, being economical with truth, are 2 of the many tools in the locker. If the company succeeds it will ba bonus, and secure a financial legacy for generations, but it is not crucial. The CEO will have cohorts with similar objectives, and accountability will not be 'on the table' for discussion.

It is particularly sad with EQT, who have a product with all the necessary merits to 'make a difference'. The 'fat lady' has cleared her throat, but not yet near an outburst.
