Maybe precisely in this case defendant may have other motivation, a project or auction may be burdened or stalled for years in vain, causing more costs or unrealizable gains missed. Etc.

I would agree on an early settlement of 250-300 m ... :-) if payed this year...

As I read this set aside process is used nowadays as a quasi appeal, more of a last resort to a losing party.

May happen due to correct, convinced reason, but also for politocal reasons, (or a simple.obvious fact that lawyers get larger fees to lengthen the process... ). One more: tactically an award may be cut, as opposed to a lenghty procedure, the awarded claimant may accept a discounted offer from the other party in exchange for a immediate settlement of payment. (In case of Greenx and Poland I guess more than one reason are in play...:-)

Panman, Marcin enlightened me, that Unictral (Greenx, PAT) differs from ICSID as there not an ad hoc committee decides on set aside procedure but local courts. Thats why it is not indifferent in their cases that London or any not trustable country is the host of that local court.

What about ICC? Do you know whether there is a chance for the defendant to prolong the procedure even after ruling?

Do anyone no of you, that in case of ICC arbitrations, is there a possibility for the defendanta to initiate annulment procedure?

ICC1 the defendant was ETAP. Quite fsctual concrete claim for compensation for produced and sold but unpaid oil.

ICC2 and ICSID defendant will be state of Tunesia, and I guess the company will seek compensation for the whole lost business, lost potential revenue, reserves, etc

SC the subject of the cases are different.

One more thing, the crowd moves when they.see the sp movement already. Saw that in ZEN, most came just around at the local top (sp to claim arount 8-10 % - but after it drawdowned to cc 5 %).

Slicey I almost argued with you making mistakes that prcedural legal costs etc are not proportional to the claim or award.... so a 50.times bigher case wont carry 50 times larger such costs... them checked the RNS again. And the bulk of the extra on award was interests levied till SCC1 ruling.

Maybe its just technical, but from 1-2% we rose to 5 % than around 8-10 % of claim, then fell to around 5 % .

I wouldnt expect significantly lower, as a thumbrule, these cases tend to stay and fluctuate around 5 % and 5-10 % around hearings, before ruling, and we have additiionally smaller won case already and not that distinct possibility of early settlement. I think the latter (and the sudden widespread news about swift moving upwards thus new investors) was the main factor of reaching the 10 % level.

...and we will "deprived" of the long hard energy consuming road of decision making about to sell or not to sell....

And one addition, how important arbitrators track record.and bias or stance in the past may be essential. A well known expert told that me in commection with SVB one of SVB s arbitrator was against lit fin backed cases, regardimg them as financial speculation, that may be an additional risk.

In PAT we may be at in a better position with our arbitrators.
