Gal, you are right with Gabriel. In their case every sane people would be against their project. Even in the neighboring country (Hungary) there was a wode protest against them. It another question, and was the center of the claim, how the gov invited the firm, and for political reasons how the managaged the environmental permiting process.
You have mentioned the essence of these cases are likelihood, conpared to price.
It really well worth reading the annulment request of Gabriel. After I came across a brief excerptsof that, I ve come to the conclusion that although their chance may low to succeed, but far from zero, while their price is practically (almost) zero.
Their arguments regarding the lack of indepemdene and impartiality of the arbitrators with each other, the government, and their law firm seems quite valid for me.

PAT has a high probability to get to court, and the process and then hearings will be more than enough for us to partly take profit and derisk.
