onlooker i agree, compare the update to the other two rns it was worded differently, no mention of revision application and annulment application. The deadline for annulment application is 6th april 2017, thats the date i am looking forward too now...

The forgery dismissal application came about and one reason was due to Noor saying he was tricked into signing the exploitation licenses, he failed to show up at the tribunal and his statement about being deceived wasn't provable. Then at the hearing the Indonesians and witnesses conceded that the forgery of docs wasnt possible without insider, now you know my position they lied and deceived the tribunal with this regards. We have a very strong chance for annulment, but the only question is will the Indonesians break and settle before then.

One important thing the Indonesian have always maintained that the Exploitation licenses were correctly signed and that Mr Noor was deceived into signing the licenses, the person(s) that deceived him was Ridlatama and Putra. But the ironic thing is Putra still works for the govt and Noor doesnt. Who is the culprit here?

Darreb You only need one ground to get the award annulled, telling an material lie which effected the conclusion of the award is big. Don't forget using inadmissable statements in the award can he another. Perjury is same under international law and Indonesian law. Rest easy...

Fact is without the insider there was no chance of forgery occurring according to Indonesia and their witnesses, now with new revelations the narrative of putra being insider is in great doubt. Rois narrative has crumbled. Notice they have gone really really quiet. Roi are in trouble. . They can't worm out of this one, for sure....

The character of roi will come into question, what else have they lied about? Those docs that chl requested roi said they couldn't find them as the bureau was in a mess. Roi will have to pay something to chl. This is a blatant asset strip. Icsid will be under pressure, because this verdict will be in record and so will the annulment application.

Darrenbiggs Indonesia and their witnesses have conceded that an insider had to be involved for the forgery of the documents. According to Indonesia Putra is a criminal who assisted Ridlatama, but this same individual continued to work for the govt after they found the facts and then they lied to the tribunal about his whereabouts. They conned the tribunal, if they genuinely were robbed by chl they wouldn't have blatantly lied, the annulment is a certainty on this point. Roi are in trouble.. Perjury is perjury...

My small bet expires next week, IG can request 100% margin until the situation is rectified but that would mean they have to do that with all spreadbet holders of chk. I know if it goes to liquidation or administration IG request 100% margin and give proceeds once everything settles.

roi said that person was putra and they blatantly lied about is whereabouts, thats why i think we have a chance, Roi lied about this, what else have they lied about? Perjuring yourself is not good... The tribunal cant just say that the licenses are not handwritten they need to come to conclusion how all this unfolded, without putra allegation and noor not attending roi dont have strong case, especially with them not providing main docs...

Now if he is the criminal why did roi transfer him to another regency and reward him, why not report him to kpk corruption unit or police? Not to mention they blatantly lied at the tribunal. This was a big lie, because of this the award will get annulled, ask any lawyer/barrister they will tell you same. Insider theory is not credible now on the balance of probability...

Darrenbiggs So who registered these licenses in the bureau? Why were they registered if they were photcopies? Why is the insider still working for the govt? Why did Roi "con" the tribunal and blatantly lied about Putras whereabout and his employment? It doesnt matter if they are autopen signatures what matters is who authorised them, im sure chl will cover this.

See I don't think they were suppose to be hand signed, this might be another lie from roi. Chl requested comparative mining licenses for same period tribunal deemed they were burdensome. There is no police report released yet regarding forgery but what we do know is all suspects have had their passports returned and free to travel ie Mazak and Ridlatama.

Fact is corruption can be proved on balance of probability. Roi told a convincing story of a sophisticated fraud between ridlatama and insider working in the regency to dupe roi. The story has crumbled as roi deliberately lied to tribunal about Putra, this was a material lie. Even if roi spin this and say putra apologised for his part, fact is Putra and ridlatana have conned chl if you follow roi narrative. Kpk and police has a duty to convict Putra if this was the case. I don't think Putra was the insider. Icsid have a decision to make, its not very difficult. If roi can lie to the tribunal and perjure themselves they can also lie about the whole case. I think this award will get annulled..

Rebel It seems it bother the tribunal more than roi. :-) But both roi and tribunal have been caught out, one of the most bias decisions in icsid. I'm a lot more positive than I was in DEC. That's for sure...
