uncanny before we start writing off our investment shouldnt we wait for the appeal details, what if there is an highly material "ground" for annulment. Why dont we wait for the appeal to go in and then make an conclusion.

All i say is CHL have a very good chance to annul this award, that doesnt mean its certain, but im really hopeful. Have you tried contacting the company? blitz/ivory/gbot blitz it was a bad decision, the 3 arbiters reputation has been tainted, we will prevail at the end. According to CHL the award made many determinative findings that were well outside the scope of the Document Authenticity phase as identified by the Tribunal arbitrators in their Procedural Orders.

mike Oxus are being dealt with another organisation, but annulments at ICsid take around a year, some are alot quicker, it all depends on damning the evidence and how far Indonesia want to take it. I am not imply its going to be a slam dunk victory but chl have a very strong case. Fact is Noor was important to both the exploration and exploitation licences, he failed to show. CHL from day 1 maintain that both licenses were properly authorised by the Eask Kutai Regency Govt. The company believes the signatures and Regency chops were applied by Isran Noor when he was deputy regent under Awang Faroek Ishak, Noor was the authorized delegate of Ishak when he was away from regency office for other business or his campaign for position of Governor of Eask Kalimantan. With Noor refusing to show up and denying this, Indonesia doesnt have a strong case, and then you see Noor wealth significantly increasing..

onlooker this decision surprised alot in the mining industry and the law industry, its makes you think did they think that much of us and passed it along to their junior assistants to write up the award? With Indonesia being such a corrupt state, it is well known judges in Indonesia have been bribed, corruption has to be investigated, not saying there is but it needs to be checked. IMHO

rebel that case concluded in dec 2009, its begs the question why did they have Professor Gabrielle Kaufmann-Kohler as President of the Tribunal? I can understand both parties selected their own arbiter but why did the icsid secretary general assign Gabrielle Kaufmann-Kohler when all three have sat together previously. we will get them, thats for sure..

I still cant believe how former High Court judge and two senior law professors wrote up this award, there are many procedural breaches in this award, i mean take the referring to and relying on witness testimony that they themselves had ordered be struck from the record, this is a ground for annulment even i can come up with this one! These are world class law professionals, it makes you think who actually wrote this award because a good arbiter who's professional reputation is at stake in the quality and robustness of the decisions they hand down and they dont like to have their decisions overturned on appeal or annulled, this one is littered with procedural breaches. I think we have a good chance to get this annulled..

Listen mate, have you contacted company? Are you in the law business? Or is this your own opinion? I believe chl have strong grounds to annul this award, they might surprise us all. I'm waiting for next update with optimism. IMHO chl will prevail at the annulment.

Ivory Why don't you contact the company? Annulment is the most likely route!!! You don't need new evidence for annulment.

I think the main thing is that the company goes for annulment and gets the award annulled, for this chl does not need new evidence. A lot of procedural breaches by the tribunal have occurred ie things like using inadmissable statements in the award. Someone forwarded this link to me and its very interesting, its written by Audley Sheppard our lawyer and talks about corruption, well worth a read. http://iacconference.org/en/archive/document/contracts_taken_to_international_arbitration/ I think we should look out for 6th April 2017, as this is the deadline for annulment, if you look at past icsid annulment app most are submitted near the deadline date I don't think chl will wait for the last day but near enough to that day. I'm comfortable and this award will get annulled no matter how long it takes.

Lselee Indonesia will lose a lot of credibility if all this about misleading tribunal is true, the old arbiters are gone and new ones will be selected. Indonesia and chl will not have a say on who will be the new arbiters. I'm hopeful and confident.

annulment is the most likely route but since the Indonesians have mislead/conned the tribunal there is a small possibility of settlement... imho

annulment application will have to be made by 6th april, there are no extensions. So another three and half weeks we will know either annulment app or settlement...
