You cannot have a system that deploys international searches and written opinion that then can be overridden after the search and data has been questioned ......... by a fresh local search and examination ...

because the original search would have found it ... makes no sense

It would mean you cannot trust the PCT system .... so what is the point of it ?

any lawyer will always have a slightly different opinion on how it should be worded .. but all would agree that the original patent, then amended etc that has passed international scrutiny has to form the basis of acceptance ...

otherwise it all falls over ..

But it has to be around the Patent application and the fact that the Art survived the International search and opinion ..

Konar you have national examiners ... but they have to also refer back to the International search and the written opinion otherwise again you would have 152 international searches ... with a 152 opinions with 152 examiners negotiating and trying to understand the art with scancell your bureaucracy that you are creating to support your posts are getting a bit ridiculous

you dont have to ... the point being the early searches would have found Prior Art
