as i have just stated, if a discussion was taking place between the US patent office and the EU patent office a paper trail would be created as the single point of application would require a question put back to scancell ....

now any discussion would be at the International search stage ... that circulated written opinion ...

don't you actually follow the thread Ruck ... bermuda was suggesting that the PCT was only just about the application point .. when actually the International search gets a written opinion which is adopted, otherwise you would have 152 written opinions .. and our poor lawyer would have to translate and reply into chinese or 150 languages and deal with 152 different jurisdictions based on 152 local searches

so we have this set procedure but the ultimate decision is still with the member state but based on the Written opinion and search which is why Scancell only had to deal with one negotiation and questioning

The point of this TF is if you are so interested, you can actually do your own discovery ... if its of such value to you.

because most are not interested in minor details of how the patent is progressing because the primary application point has been approved, thus others will follow. Indeed would the CEO know how they are progressing ? what formal paperwork comes back to the applicants jurisdiction that informs on progress in another PCT member state ?

Its important to understand Prior art ....

so even if the US had discovered moditope and patented it only in the US and released the Papers ... the ART is now public thus trying to get a patent in the EU would be impossible because its lost its novelty

so in that event anyone in the EU anyone could manufacture or develop moditope because the US holder of the patent did not protect that jurisdiction

remember Graphene ? they did not patent it .

but it has not stopped further patents as the technology has been developed ... which then become suitable to apply patent

No i am not .. the point i am making the single patent application generates a sequence of events which includes the challenge to the patent itself via searches ...

so you are saying because the EU have found no infringement it may be the US might, if they have a patent already in that area but only established in the US ... but that would have appeared some years back in the searches and challenged the moditope patent

so its important to know that the "international Searches" have not thrown up an issue ...

Scancell presenting at Scientific conference events .. most of the data presented has already been released by scancell in events that target investors not scientists. so the relevance of them attending events shows us they are still engaged in the most important area of marketing the science to scientists which tend to be from other universities with links to Pharma and Pharma itself, which is after all Scancells target market ... so the Valuable PR is done behind closed doors .
so again this PR to shareholders is important, however its not a commercial area to Scancell as we move from Market led cash raising to fund development, to Product led cash flow which will fund future growth

Scancell has already started talking about "non dilutive funding" and indeed future development of the modi3 program is indeed NON dilutive if the CRUK grant is won, and so is SCIB2 deal with CRUK

Identify the question to ask ? is not that easy

Its the importance of issuing that news, would it make any difference ? i think not, the data that is considered missing is IMHO an excuse for those to have a moan ... as we both know under the patent system we have you cannot have conflict between jurisdictions otherwise no point in having the PCT in the first place ...

Missing PR ? we have just had the most impressive science update ever .. that is two this year, no amount of PR can compete with that if folks are not understanding the potential scale of the moditope platform then PR on this matter will not help. Scancell only has its science and all the web around the globe that has developed from that. I really am not sure what PR they now can do.

Still i did spot that BioNtech from Steves recording .. so again that in my mind is proof that a deal is very close with BioNtech (six months) or the Grand Challenge

I dont think the value will change on the over all deal with the epitopes ... with BioNtech its how its loaded, ie more data that is available front loads the deal, less back loades the deal subject to trial inflection points etc. From our point of view Front loading helps our cash flow and saves dilution
