larry - i believe the odx case is completely different. they signed a contract that they didn't understand and was completely loaded against them. they were put on hold in case the gov needed them with no minimum contract or recompense for such
odx did not even realise it had lapsed until a month after.
their dispute is over a pre production payment that they received but then they never produced anything. so the legitimate question is how can they be entitled to it?
i have been through the odx contract and they have in my opinon a very dubious case...they massively increased staff levels - possibly to get ready for phase 2 - as there were penalties if they couldn't fulfil requirements - however they never got to phase 2 and the contract was very clear that no funds supplied were to improve the non gov part of business.
the article itself is sloppy journalism.
if you read odx are not "pursuing" as in taking them to court ..but

odx prob do not even have the cash to take any legal action against the gov. i am sure they are in dialogue with the gov in trying to resolve the dispute...but i suspect the gov will threaten them with court like ncyt.
the difference is ncyt have in my opinion a much stronger case and the finances to go the distance
