"On 1st October 2020, Ocado Group was notified of a press release from Norwegian technology and robotics manufacturing company, AutoStore, around an alleged infringement of their rights.
At the time, we confirmed that we had not yet received any papers in relation to these claims from AutoStore, that the press release was the first we had heard of the new claim, and that we would investigate any claims once we had received further details.
We have since received the papers in relation to these claims and, after a preliminary review, we can confirm that we do not believe any infringement of any valid AutoStore rights has taken place.
As a leader in technology and engineering solutions, we have over 750 patents granted and pending that we use to protect the unique and proprietary end-to-end software systems and physical fulfilment assets that make up the Ocado Smart Platform (OSP), our solution enabling retail partners to lead in online grocery in their respective markets.

We have a team dedicated to the correct preservation of our intellectual property. We are currently investigating whether AutoStore has or intends to infringe those patents. We will always vigorously protect our intellectual property and are considering all options in this regard."

If after a 'preliminary review' they 'confirm that we do not believe any infringement of any valid AutoStore rights has taken place' it suggests the infringement does not exist or is obscured in the detail, i.e. not fundamental. Another explanation might be simple speculative opportunism.
