Shareholders gain more success in court!6 Feb 2026 20:10
Today, February 6, 2026, the plaintiffs in a class action lawsuit (more than 50 participants) against PJSC "Moscow Exchange", JSC "Gazprombank", and OJSC "UGMK" have achieved a small victory!
Judge Yuriy Litvinenko of the Moscow Arbitration Court, at a preliminary hearing, granted the plaintiffs' request to involve OOO "Atlas Mining" as a third party in the proceedings. This company, in fact, performs the functions of a corporate center for the former assets of Petropavlovsk PLC in Russia - gold mining operations, a processing plant, and exploration enterprises.
The judge also denied the defendants' request to close the proceedings in its entirety.
Finally, the court decided to oblige PJSC "Moscow Exchange" to provide important documents related to the listing and delisting of Petropavlovsk PLC shares, and the third party - the liquidator of Petropavlovsk - a series of documents that will help shed light on the company's bankruptcy.
Earlier today, the plaintiff sent a letter to the president of OOO "YUGK Management Company", Mr. S.D. Grinko, and the board of directors of PJSC "Yuzhuralzoloto Group of Companies", in which he asked them to pay attention to the following facts:
- as of December 31, 2021, PJSC "YUGK" owned 29% of the company Petropavlovsk PLC;
- the controlling stake (67.25%–67.85%) of PJSC "YUGK" has belonged to the Russian Federation since July 15, 2025;
- thus, 19.62% of Petropavlovsk PLC shares belong to the state; the Russian Federation, and therefore PJSC "YUGK", managed through OOO "YUGK Management Company", are the victims of the defendants' actions in the lawsuit.
In the letter, the officials of the mentioned companies are asked to consider the possibility of joining the case as a third party asserting independent claims regarding the subject of the dispute (Article 50 of the Arbitration Procedure Code of the Russian Federation), or in any other procedural status that their lawyers deem appropriate. The next hearing in the case will take place on March 20, 2026.
