This section of their defence interested me :-
"Exsig failed at an unacceptable rate due to design and/or manufacturing defects and therefore lacked robustness", Mr Heppinstall told the court.
He said that Exsig tests were analysed in seven NHS laboratories, six of which found a failure rate higher than 10% - including four reporting a failure rate of 25%.
No mention was made of the 7th and I hope we pick up on this in court.
Could it be the 7th Lab were better trained and therefore their results would have given a much higher success rate.
These surely would have been identical tests provided by us.
If everything you have said does come true WBAFC then your figures could be proved and i say could be accurate
Lets win the court case first though
Then we can plan ahead and make everyone as happy as Larry Larry
This is going to court all the way and no deal will be made before than , thats what I think , why ?
1. Novacyt wants to clear the good name as DHSC have basically ruined the company reputation and contributed to SP carnage.
2. Novacyt win case, and their defence fees would all be paid by DHSC.
3. Claim for full £81.5M + [ interest ~£10M ]
4. Plus compensation for defamation [ £100-250M ]
What do people think ?
I had a chat with Kier Starmer and Prince Charles they are going to wear “Novacyt are innocent “ T shirts at all public occasions £13.50 coming soon
PI100 have faith, as we are passed the first hurdle, thanks to my old school friend (Justice Jefford). Was on the phone to her earlier and She has promised to put good ward for us. Watch this space £3.50 coming soon.
Nah classic mm's - agree with dazzerman this is going £1 plus SOON imo
I must admit I was worried the SP would just keep going up and we'd never hear from you again PI100!
It won’t hang around tomorrow £1+
Classic ncyt. 13% up this morning now in the red!
Stop loss was probably hit while they were not paying attention.
Anyway. All positive today.
There’s nothing wrong with the tests provided only human error.
The government are going to back down here or lose badly.
Who in there right mind sells 28000 at 70p when they could have got 80p earlier in day?
mmmm
Michelle Mone 200 mil - for what
This is pure delaying, nothing more
Its STILL coming home (to Nova) monies coming home imo
"Be under no illusion , the govt wanted the case stopped "
Well I did ask for clarification what you meant by this twice. With no answer . So you can't blame me if It sounded to me like you were saying they were desperate to stop it going to trial
I just think people should not get too carried away at this stage. Still lot of miles to go
Yesterday was good and bad news for me. There is something that is slightly bothering me .
I posted last night re being "Reassured" - I am glad the RNS came out exactly as expected & scheduled.
One other point I forgot to highlight is the seemingly pointed fingers at The Validation Group (TVG) in the Twigger refute. So, this could be the save face / way out for the settlement.....I.E. not the govt fault, TVG did not clean the data up as well as they should have. Of course, I imagine it was the govt who commissioned TVG and hold final responsibility for how it used and what caveats are in TVG's reports......but it is certainly a way out.
We march forward with confidence, IMHO.
Feck sake change the subjects, where r we going to have the Party. Drinks on me all night and K, I will for your flight from Paddy Land.
I'm not suggesting they are desperate at all. They applied for a summary judgement in the hope it was upheld. I am well aware they instigated proceedings. Since instigation they have been privy through mandated document exchanges to our evidence that their claims are unfounded.
They then applied for summary judgement late in the pretrial period. I believe they felt that full examination of Novacyts defence would ultimately be detrimental to their claim and therefore tried to circumnavigate that happening by applying for a summary judgement.
Yippee it failed.
Off out no more to say on the topic.
Val...different govs obviously ..but I do AGREE with you...same xxxx
But it also supports my view that the gov want to be seen pursuing hard earned tax payer money.
If they win quick and cheap ..good
If it goes to trial...good
If they win...good
If they lose...good..they were seen to be chasing...money will make little difference to them anyway
They are also the ones, that brushed Post Office, Windrush, etc etc and enriched themselves through Covid contracts... etc etc
They care about only themselves, not doing the right thing, until JUDGEMENT forces them to!
Its our money they are using to fight their case with , not theirs? If it were, they would never have claimed... Sad unscrupulous lot, all of them! imo
Karen
We are not talking about the ramifications on them bring successful. We both are agreed on that if you read. I have already explained why I think they made the application..trying it on ....as val says on the cheap..cheekily. But that is a lot different to
"Be under no illusion , the govt wanted the case stopped "
You suggesting that they are desperate not to go to court..just doesn't make sense
Remember they are the ones taking ncyt to court in the first place.
Why do you think the DHSC made the application ? Do you understand the ramifications if they had been successful. I do CS , yes they wanted to stop the case going to trial.
I will re read your post... glad you are in the posi camp :)
"Disagree Cap, they wanted to win "on the cheap" now, the Dhsc know they cant!"
you are not disagreeing with me - that is what i am saying
they tried it on - tried to bully.
does not mean they are desperate not to go to court
Plus with with so few shares, as Traders sell and lth's buy them up, it is going to be even harder for the Trader to sell, post negatives, and FAIL to re buy lower... #FingersCrossed :)
Disagree Cap, they wanted to win "on the cheap" now, the Dhsc know they cant!
And using testing failure, when they continued to buy from Nova, shows they are two faced!
Its about wanting cake and eat it, cuz they dont care about spiffing tax payers pounds, WOULD BE DIFFERENT IF IT CAME FROM THEIR POCKETS!
As soon as Nova PROVE tests are accurate when done CORRECTLY, this will all be over bar the AMOUNT the dhsc have to pay up!
I seem to recall a specialist test centre in West Mids, failing miserably due to poor training and was highlighted in the press? Im sure dhsc went to cheapest options and hence it is game over as far as I am concerned...
Its just a case of when now...
#atadmorepatience imo dyor
