Hi Kaeren .....what usually happens initially when products are outsourced .problems.what happens when people work day and night pressured ..mistakes.. blame of anyone ....Asked.... to help when the problem is moving and changing quicker than the answers.... Don't sit well
Yes Ventura , I noted that . If a manufacturing fault or design issue than you would have expected a consistent fail rate across all labs , not a range of 10 % to 25 % and no mention of the 7th labs results. Most odd. Without doubt Twigger will have picked up on that .
Lol, be great if they've dug their own grave and the 7th lab was one we trained .
Strange this supposed design manufacturing fault wasn't identified during the 50 training sessions , pretty certain the Nova staff would have noticed pdq if they were getting unexpected results.

This section of their defence interested me :-
"Exsig failed at an unacceptable rate due to design and/or manufacturing defects and therefore lacked robustness", Mr Heppinstall told the court.
He said that Exsig tests were analysed in seven NHS laboratories, six of which found a failure rate higher than 10% - including four reporting a failure rate of 25%.
No mention was made of the 7th and I hope we pick up on this in court.
Could it be the 7th Lab were better trained and therefore their results would have given a much higher success rate.
These surely would have been identical tests provided by us.
If everything you have said does come true WBAFC then your figures could be proved and i say could be accurate

This is going to court all the way and no deal will be made before than , thats what I think , why ?
1. Novacyt wants to clear the good name as DHSC have basically ruined the company reputation and contributed to SP carnage.
2. Novacyt win case, and their defence fees would all be paid by DHSC.
3. Claim for full £81.5M + [ interest ~£10M ]
4. Plus compensation for defamation [ £100-250M ]

Yesterday was good and bad news for me. There is something that is slightly bothering me .
I posted last night re being "Reassured" - I am glad the RNS came out exactly as expected & scheduled.
One other point I forgot to highlight is the seemingly pointed fingers at The Validation Group (TVG) in the Twigger refute. So, this could be the save face / way out for the settlement.....I.E. not the govt fault, TVG did not clean the data up as well as they should have. Of course, I imagine it was the govt who commissioned TVG and hold final responsibility for how it used and what caveats are in TVG's reports......but it is certainly a way out.
We march forward with confidence, IMHO.

I'm not suggesting they are desperate at all. They applied for a summary judgement in the hope it was upheld. I am well aware they instigated proceedings. Since instigation they have been privy through mandated document exchanges to our evidence that their claims are unfounded.
They then applied for summary judgement late in the pretrial period. I believe they felt that full examination of Novacyts defence would ultimately be detrimental to their claim and therefore tried to circumnavigate that happening by applying for a summary judgement.
Yippee it failed.
