How does anyone think legal action will get this decision any time soon....it will take years...a veiled threat and political pressure is the best route. Pretty shocking though....noted Baylan's lame answer to KU had no element of forthcomingness
Yes, it will be dealt with but it simply means that no decision will be forthcoming under this government or any future coalition which includes the Greens.A major shake up required to change any of this mess.
He clearly references Auras's legal action for compensation - a veiled threat - just wish it was more explicit.

Time for legal action is long overdue.

"In the Kallak case, the Minister has commented on there being 'several different national interests.'
"In the County Administrative Board's ("CAB") assessment in July 2015, it stated that there are no conflicts within the Kallak Concession area where national interests are considered, as the Concession area is designated as an Area of National Interest for minerals. No other national interests were identified.
"This remained the case until Sametinget placed national interest for reindeer herding directly on top of Kallak in February 2017, 11 years after Beowulf acquired its first exploration licence and had invested the majority of the SEK 80 million spent on Kallak.
"As we have repeatedly stated, it is not a case of mining or reindeer herding, as both can prosper, as they already do across Sweden where industry and reindeer herding interact. Kallak will be no different. That is Beowulf's commitment.
"If the Government sticks to the facts then the Concession should be awarded. The Kallak application has been assessed to the absolute limit and there should be no need for further deliberation.
In the letter to the Minister, the CEO made the following points:
· Two and half months have passed without any new information on what is happening, since the Minister wrote in his letter, dated 30 September 2019, that a decision by the Government on Beowulf's application was 'forthcoming'. The CEO has requested that the Government provide Beowulf with details on when the Company can expect the decision on Kallak to be taken.
· It seems evident that the coalition Government has been struggling to reach consensus on Kallak and that politics are standing in the way of a decision being taken. Yet, we have heard before, from the Government, that Swedish law is sufficient for assessing the Kallak application and that any assessment of Kallak should be 'by the book'.
· To ensure that the Government has been provided with all relevant facts, the Company submitted a concluding statement for Kallak to the Government on 8 November 2019, prepared by the law firms Mannheimer Swartling and Fröberg & Lundholm. The statement summarised all circumstances relevant to a judicial review of whether the Company should be awarded the Exploitation Concession for Kallak. The statement demonstrates that the Government has sufficient facts for an Exploitation Concession to be awarded.
· Sweden's attractiveness as a destination for investments in mining has been decreasing over several years. Mining analysts and journalists continue to comment on the inability of its authorities to decide on mining applications, while having allowed companies to explore for minerals and make significant investments.
Kurt Budge, Chief Executive Officer of Beowulf, commented:
"The Minister's comments at the recent SveMin Höstmöte look to a future when permitting procedures in Sweden are predictable, but they provide no comfort to already committed mining investors and specifically Beowulf's shareholders.
"I read yesterday that the Minister, in response to a question from a fellow politician, has stated that the starting point for the Government's handling of an application 'is always that it should be done quickly, efficiently and without compromising legal certainty'.
"The Government's handling of the Kallak application, since the summer of 2017, has been neither quick nor efficient, and is a 'black cloud' over Beowulf's share price. It makes equity fund raising more costly and is damaging the value of the 64.76 per cent of Beowulf owned by Swedish shareholders and the remainder of the Company owned by UK shareholders.
"The legal certainty that the Government seeks is contained within the concluding statement sent by Beowulf to the Government in early November.
"The Board has noted Aura Energy's ("Aura") written notification to the Swedish Government under the Energy Charter Treaty seeking compensation over the uranium ban introduced in Sweden on 1 August 2018 and the financial loss to Aura
FF23 - That's much how I read it. Everything will be assessed against the new Action Plan, when it has been implemented, and that could clearly take some time.
Yes..maybe but Sweden claims to be leading in mining technology with green credentials so how would that wash.
3CardBrag/Juicy - although iron ore is not a fossil fuel ti requires a lot of energy to get it out of the ground and process it. The decision to integrate climate change policy into all other policies can only result in a review of mining applications/decisions to assess whether they fit the new policies. Or in other words it's a great way to move the goalposts on applications that used to meet all the right criteria but were awkward to grant for other reasons. That's not to say we won't get there in the long run but a determined government could easily stall whichever processes it wants to for a good couple of years under a climate change policy pretext.
Difficult to know which bit of that answer is the most ridiculous.....possibly: "The government determines the cases when they are sufficiently prepared so that decisions can be made." Will the KU Committee take that lying down, I doubt it.
Juicy. Not sure what that has to do with our mining project as it's not a fossil fuel issue, although it does highlight very significantly the mindset of the current shower in charge of Sweden.
I think the time is up Kurt's next move should be legal even if he has to come to the share holders for a top up " we have a concrete case if all what Kurt's tells us we cannot lose in the high courts , if they don't want us to mine then we should be payed the full value plus interest on the commercial value of the mine which would be billions of sek " some how there must be some think missing for kurt not to go down this rout .can any one tell me why we are not going legal because if l had spent 77million sek plus l would want my money back,

A comprehensive policy for the climate

The Government is presenting for the first time a climate policy action plan for the Riksdag. The climate must be integrated into all relevant policy areas. With 132 measures, the bill takes a holistic approach to how emissions should be reduced throughout Swedish society.
The development for the world's climate is worrying. Right now the world's land ice is melting, the temperature in the seas is rising and huge forest fires are becoming more and more common. The Earth's ecosystem and human welfare require a stable climate.
Sweden is now taking an important step by integrating the climate issue into all relevant policy areas. The first climate policy action plan contains over a hundred measures that the government will take during the term of office, which span the whole of society.
- The climate crisis is a serious threat to prosperity and security in the world if we do not get out of fossil dependency and build environmentally sustainable societies. Ignoring the researchers' persistent warnings would be totally irresponsible. Sweden can go ahead and show that a fossil-free world is not only possible but also benefits our prosperity and our companies. It is unique that Sweden now comes up with an action plan the basic concept that climate considerations should be included in everything we do in society, says Environment and Climate Minister and Deputy Prime Minister Isabella Lövin.
The Government's overall proposal in the bill is that increased efforts should be made to integrate climate policy into all relevant policy areas. All sectors of society need to contribute to achieving the goal that by 2045, Sweden will not have any net greenhouse gas emissions to the atmosphere. The work of integrating climate policy will include reviewing all relevant legislation so that the climate policy framework will have an impact, that in connection with the next review of the respective social goals, the government will, if necessary, reformulate the goals so that they are compatible with the climate goals, and to make impact assessments for climate for the proposals in the areas where it is relevant.
The Action Plan contains 132 measures that the Government intends to implement during the term of office, both in specific sectors and at a general level. The plan covers sectors such as industry, transport, consumption, public procurement, agriculture, forestry, financial markets and international climate work.
Cheers Oaktree. Kurt must find a way to break the Swedish Government's inertia. If he can't do that within the next few months, and we continue to have the fob off, then the sp will quickly look even more dire. The Swedish Government cannot just state that Kallak is a complicated matter, as our application has twice now been on its table, for a combined time of several years, and it's six years and eight months all told, including also MI and CAB perusal times.
Nobody, and I mean nobody, can say that there hasn't been enough time in which to bring a decision on our application.
My feeling is that Kurt has to formally request the specifics as to the continued delay, because general replies are not appropriate. It's far too easy for the Government to remain unaccountable if the details are missing.

It's a joke. That's the line the government is spouting and I'm sure they will stick with to buy them as much time as possible. Question is, is it lawful or not. Everything is made to look much harder than it is. Roll on 2020 lol

Decision on mining in Kallak and Laver
Lars Hjälmered has asked me if I can explain why a decision in the case of Kallak has been delayed and for when the government will decide on possible mining in Kallak and Laver.
As I previously reported, the case concerning the applied processing concession for the area Kallak K no. 1 in Jokkmokk municipality contains extensive documentation with several complex legal issues, for example, balances according to the Environmental Code between several different national interests. This obviously affects the processing time.
However, the starting point for the government's handling is always that it should be done quickly, efficiently and without compromising legal certainty. The government determines the cases when they are sufficiently prepared so that decisions can be made.

Afternoon. When BEM increased their stake in Kosovo, they are exercising an option to do so only. Usually, there is a penalty attached, because BEM are not legally obligated to exercise that option. My guess is, KB negotiated this deal type, in his belief, that a positive decision would have been made earlier re Kallak, and the SP would have been higher, and thus, any further funds raised re Kosovo, would give us less dilution (cheaper). Swings and roundabout? Perhaps not! Imo only. atb
