OS, I did not do a deepdive in the lawsuits and I didn’t buy the documents since I’m not a lawyer and think I do not understand them therefore good enough.
Would be good if someone with more knowledge could help out.
Personally, I have written some IP myself regarding electronics (and even some are granted) and having done some reversed engineering on Ip by using tools like triz, I’m Almost 100% sure that it will be very dark grey:
I think cap-xx ip is very strong and written down in such generic terms that it covers almost every supercapacitor. The fact is that the older companies (like tdk,murata and avx) who have their own ip departments decided to work with cap-xx. I think they did their homework before signing.
The young and fast companies are mostly ignorant to IP ( they all think “open source”) and are more focussed by going Fast to market and earning money on short notice. After scaling up, they learn that ip and manufacuring IP is costing a lot of effort and money and they all get more carefull... This story is also valid for Musk.
And as stated a few months ago, if Musk paid >200 mln$ for a company under the assumption he bought the ip, he will not be happy.
