In arbitration the burden of proof generally lays with the party making the initial claim.

This stops arbitration being weaponised by disgruntled parties.

So much is being picked over daily here but at the end of the day the overall status of GST is hugely disappointing.

If GST should be suing anyone it should be the auditors that used ahead of the acquisition.

Tell me they had Semnet audited beforehand or was the whole thing done over a glass of Suntory and then lamented 16 months later? If the latter, then it’s in keeping with how shoddy this coming has been run since it was taken over.

As I’ve stated previously. I’m surprised that we have not seen a considerable counter claim being submitted against GST. That’s the usual counter balance gambit that most defence lawyers use.

The much anticipated ‘Corporate Update’ will just be a rehash of all the stuff you know already with little actual progression apart, of course, from some bad news or ambiguous news thrown in at the end.

Bar Angra, these guys have delivered nothing.

It’s almost inconceivable that a company which is still technically a start-up has such little news on progress for such long periods.

Ask anyone who has worked in a proper start-up and they will tell you barely a week goes by without something significant and note worthy developing.

The fact this S-show can go 3-6 months with no news tells you all you need to know. Basically, some old dudes with a mid-technologist miss the crypto bandwagon by a mile and are now wondering what to do.

The GST analogy

So , based off a promising pitch you invest £25-50k into a business to be set-up by some foreign strangers you’ve never met and know little about. Let’s say it’s a corner shop.

After a while the application for an alcohol license is rejected. They ask you for some more money as they have a few more ideas. They were a little vague about how why the application failed but business is business.

A while after other applications , late opening, Sunday trading gets rejected. Again, they are not clear why.

Soon they stop picking up the phone, emails go unreplied. Then you find out they are embroiled in a court case for something they invested in that wasn’t really part of the plan.

You realise that you have no idea who these people really are or even where they live.

Chances of getting your money back are less than zero and the authorities don’t care.

This is going to be one intense ride.

It’s worth pointing out that unlisted, the company would not be as regulated. Considering how poorly they have behaved whilst regulated the I would shudder to think what would happen when the finally delist

Singapore is a notorious scam hub for fintech , particularly UK listed ones.

Equitini very very rarely deny providing an updated shareholder list , especially when you pay. Normal you pay a standard fee for the top 25 holders or £150 for the entire list.

The fact they are main market and registered abroad limits the regulatory reach and many such set-ups previously have been late and vague.

Even UK based companies have been a little greasy on this point. Anyone remember ODX (Omega Diagnostics) during their hot moment during covid, when the SP was insane, their main shareholder was dumping like a demon. No-one know who it was and only after 2 months after dumping did he (and former fund manager) post a TR-1 declaring he was sold out.

So I’m not expecting much from a non-British citizen sat in possibly Singapore (who knows where they are really are)
