RMG and the CWU have, over the last several weeks, been taking part in informal mediation...the mediators report is, I believe, due out this Friday. As for strike action -- why would it be illegal? RMG has a choice: involve themselves with the CWU in formal negotiations, or, continue to decline to participate and in the very near future receive notice from the CWU that they intend to take strike action. The legal requirement for taking strike action is one weeks notice -- from the participants to their employer. Royal Mail will drag this out now over the next several weeks. First the mediators report. Then their refusal to take part in formal negotiations. The CWU putting them on notice of an impending strike. And, finally, Royal Mail agreeing to formal negotiations...after all this, a week to appoint an arbitrator and three weeks negotiation. So, in my estimation, that brings us up to the start of December: probably about the earliest a strike could legally take place. But that is still more than enough time for a CWU national strike to put Royal Mails "Five Year Plan" back a lot longer than just five short years. The cost of such a strike would be astronomical!!!
