It is true that shareholders do not own a company’s assets directly, which is what the 1948 Court of Appeal remark referred to. But that does not mean they are not owners at all. Under the Companies Act 2006, shareholders are the company’s members, recorded in the register, with enforceable rights to dividends, votes, and residual value. Regulators and statute consistently describe them as owners, because they are the only group whose own capital is fully at risk. In law and practice, shareholders are not co-owners of assets, but they are the legally recognised owners of the company itself.
Meanwhile, good to see the share price rallying, let's hope we get an update or two from Solgold this week, ideally, a strong update just before the summit starts on Wednesday in Colorado.
