I'm actually quite happy about this development. It's a clear nail in the coffin of the contract with the government that gave DHSC a right to control third party sales. As of 15 February the UK-RTC will be free to sell the AbC19 test to third parties both in the UK and overseas.

It's also worth remembering that the AbC19 test was never originally intended for home use. It was designed for professional POC use - and PHE at Porton Down has confirmed it meets all the requirements from that perspective.

The home use issue was a post-development change in use requested by DHSC. As this was not a class of device intended for home use, that required MHRA approval... problem was, there wasn't actually a TPP or MHRA process available at the time for home use LFT approval (the LFTs in use for surveillance purposes were being used under MHRA EUA).

My view is that this news will scare off some investors and the price will bounce around wildly for a bit, but the LTHs will know that this is a solid company with strong Covid products and a wider portfoilio, and that the share price will recover and improve over the coming weeks and months.

If this news means I get a further chance to top up at a decent price I shall do so.

Most governments are not handing out contracts to MPs' relatives and party donors... and if you look at the figures, then there does appear to be some sort of link between the level of corruption around Covid-related public procurement and how well (or rather badly) the countries are doing in tackling Covid. The UK and USA are prime examples.

The Good Law Project aren't the bad guys here. Those who actually understand procurement law and the judicial review process can see the potential benefits to UK-RTC of the action the GLP was taking. Forcing the government to comply with their transparency and level playing field obligation actually improves out chance of getting a significant chunk of the testing pies, as it stops the government from handing out contracts based on whether the owners are related to Tory MPs or are donor to the Party.

Even if the government loses/lost the JR case, it wouldn't impact the existing contract. The High Court does not set aside extant contracts in such cases - it's decision applies to future actions.

The Innova test is *NOT* approved by MNRA for home use. It is being used under a temporary MHRA EUA that bypasses the requirement for formal approval.

ODX are not selling the AbC19 test. The AbC19 test is sold, on behalf of the UK-RTC (which includes ODX), by CIGA.

It's legit. The FT have published details (it would be interesting to know their source) in an article and as a result the Good Law Project has confirmed that they have been told by DHSC MHRA home use approval was not obtained by the deadline in the contract and thus orders cancelled. However, this contradicts a statement made by DHSC in the same proceedings just a few weeks before when they averred that MHRA approval had been granted.

This could prove very embarrassing for DHSC...

I though that might be it. The problem is that it flatly contradicts what the Government said on 2 December 2020 in a formal response to the GLP claim. So the question is: were the government lying on 2 December 2020 or on 21 January 2021? Or both?

The Abingdon RNS yesterday is clear: "Regarding the current DHSC contract, as noted previously, this will expire on 14 February 2021 and, in-line with the Government's shift to a dynamic purchasing strategy, the Board expects that any future orders will be received via an application by the Company to future DHSC tender notices."

This says that the current contract will expire (not that it is cancelled) and that the changes relate to future (not current or prior) orders.

Out of the two, who do I find most credible? Abingdon or the DHSC? Have a guess.... ;0)

I did wonder if that was what was being referred to. In which case we need to be clear: GIGA has *not* "...won a share of the £15 [£20] billion...".

It has been accepted on to a non-exclusive framework agreement for potential activity which could be worth up to £20 billion over four years. Inclusion on the framework is no guarantee of any contracts/orders.

Have you got a link confirming what has been awarded and what for?

This was a framework tender for lab-based services, with some professional POC testing elements.

It's interesting to note that some late entrants appear to have been added to the list published and that it is a 'non-exclusive' framework, which means it will be open for other providers to sign up.

Now which company has just announced it will be offering lab-based services?

Contrary to his assertion, one of the reasons quite a few people invested in IQ-AI - apart from understanding the potential of the portfolio - is *because* TB is a significant shareholder.
