I have never got too excited about the claim, but I have to agree with Ovets on this. The consensus has always been that the RKH case is strong one, a text book example of a clear breach of the treaty. The numbers you provided don't mean anything if nearly all those cases are not as strong as RKHs one. There would be a spectrum of strength, so if the RKH opinion is correct, they would be in the 27% of success cases.

I think Belgium are seeking clarification for new actions filed whilst they are negotiating the shape of the future agreement.
