ABDX posted their grounds for resistance on LinkedIn. It was mostly Abingdon staff that liked it, and one commented as follows

Clearly ABDX staff seem just as peed off with DHSC as the rest of us. They've all lost colleagues and are no doubt concerned about their own ongoing job security.....

But it does beg the question, why hasn’t this become a market already?? Nobody tests for their flu immunity do they, nor do I see any craving to do so.

I do agree that LFD’s generally have plenty of opportunity, and as a manufacturer we must be well positioned to take advantage.

All ABDX ever seems to post about is ABC-19, so it smacks of their having put most of their eggs in that one basket. But nobody seems to want the test. “Imminent” (CK) orders have remained imminent for months, and stocks we’ve been building for months are at risk of perishing in the not too distant future I fear.

There is absolutely a focus on Ab tests now, and it is clearly a priority for the FDA. But the focus is for quantitative and not qualitative tests. Yes, we are launching a semi quant method in August, but only for research use and based, I think, on a card indicating the strength of immune response given how strong the positive test line is. Doesn’t sound hugely scientific to me.

And I can’t see people wanting to buy tests for home use just to see if they have an immune response, at least not at scale. Most I think will assume they have once double jabbed.

If there is use for ABC-19, it may come at booster season, or for those countries lagging in their vaccine roll out. But let’s be honest, those countries are more likely to be LMIC where pressure on cost will be massive, particularly in a saturated market.

I believed in this company. That belief has waned and I’ve sliced over the last few months. The rest I’m leaving for old time sake.

I really wish things turn around for everyone.

They are. But when I enquired about the production jobs last week the recruitment consultant was really clear they were looking for staff only for the next 6-8 weeks, with work thereafter dependent on contract negotiations.

So it seems to me that ABDX have reduced their fixed cost based because DHSC failed to pay, and have moved to flexi agency staff for production as work comes in. I think ODX has done the same.

Because ABDX has no agreement with Calibre/Boiserv. Biosure is selling ABC-19, and has been for some time.

It seems obvious that DHSC are refusing to pay because Farrell J allowed the GLP to pursue ground 7, unlawful state aid. That’s why ABDX pay so much attention to it in their grounds for resistance.

What’s really annoying is paras 25-27 in the Farrell judgement, https://drive.google.com/file/d/1SUu5mFq_fJscTwoxfb9BZSMWJC0puRpl/view, which seem to show that DHSC put up only a dismissive argument in that respect, as if it wasn’t worth bothering about.

If Abdx had been represented there (god only knows why they werent) such that they could put forward all the facts, then Farrell J may well have dismissed ground 7 and we’d have been paid. These latest grounds for resistance stink of ABDX having to do DHSC’s job for them!

One final point of interest is that DHSC is represented by P Moser QC of Moncton Chambers, precisely the same Chambers that Ligia Osepciu, who is acting for Abdx, comes from.

Still clumsy!

Fundamentally, if I’m wanting to return from eg Spain to the U.K., I have to take an Ag LFT in Spain 3 days before i do, but GOVT stipulates it cannot be an NHS test. I’d like to know why.

It seems that its only the "Graphite" mining applications that have vanished from the portal. Quick searches for "gold" and "diamond" on the portal still list both the active licences and the applications

Looks like the substantive hearing in the Judicial Review is pencilled in for December. Whilst it’s been great to see some recent support for the stock, and real potential exists for ABDX on multiple fronts which could rocket the SP from the stupidly low levels now, I can’t see the DHSC paying up until the JR case is concluded.

I just hope we have sufficient resources/revenue to support the cost base in the meantime.
