This decision was bad, it's my opinion, yours differs...
If this judgement remains on the statute book, one can speculate it will destroy ICSID.
They are pointing at a insider that was involved in this fraud, that insider is called Putra. The tribunal states the licenses were not registered proper, they say Putra went to registrar to register the licenses when she asked for originals he stated he would give them afterwards. She registered the licenses, what a farce..
Then they say Mr Noor passed exploration docs to Putra to upgrade them, again they claiming fraud and corruption.
Putra in the past had been arrested and questioned under caution. He has been cleared by the police and had his passports returned free to travel.
So it begs the question how can tribunal come to this verdict when the state police which has much more resources failed to charge him. It's a complete farce ..
Roi brought this case to icsid the onus was on them to prove prima facie case not for chl. There is a very good chance this can get annulled.
