It takes weeks from the initial moment lawyers are instructed to put together a full case and get the paperwork ready for the formal launch of an action before a court. Even longer when there are possibly several actions (at least one relating to the misapplication of the law in 2016, and maybe another one against JL for a possible abuse of power / process (whatever the appropriate legal term is)), possibly before different courts - CJ EU and Slovenian court.
Assuming that Ascent will use a litigation finance lender (likely IMO), add a few more weeks for that lender to review the prepared case, possibly come back with additional questions, and ultimately approve (hopefully) and start the money transfer.
Based on my understanding of the RNS's and interviews, I suspect Colin has been at it since mid-November. So let's say 5 weeks spent on it so far.
Take off two weeks for Xmas and NY and if all the preparation goes well and the litigation finance company approves the cost, I'd say that formal filing of the action(s) will be around mid February.
But my barely-educated guess is that two permits will be awarded before then as an attempt to assuage Ascent. My preference would be to follow through with the action though, subject to the size of damages that could be realistically be obtained.
