Which is what I suspect (based on another barely-educated guess) will happen. But probably still after the action before the court has been formally filed.

It takes weeks from the initial moment lawyers are instructed to put together a full case and get the paperwork ready for the formal launch of an action before a court. Even longer when there are possibly several actions (at least one relating to the misapplication of the law in 2016, and maybe another one against JL for a possible abuse of power / process (whatever the appropriate legal term is)), possibly before different courts - CJ EU and Slovenian court.

Assuming that Ascent will use a litigation finance lender (likely IMO), add a few more weeks for that lender to review the prepared case, possibly come back with additional questions, and ultimately approve (hopefully) and start the money transfer.

Based on my understanding of the RNS's and interviews, I suspect Colin has been at it since mid-November. So let's say 5 weeks spent on it so far.

Take off two weeks for Xmas and NY and if all the preparation goes well and the litigation finance company approves the cost, I'd say that formal filing of the action(s) will be around mid February.

But my barely-educated guess is that two permits will be awarded before then as an attempt to assuage Ascent. My preference would be to follow through with the action though, subject to the size of damages that could be realistically be obtained.

The CEO suggested using a litigation finance company - I wrote a post explaining how it works on the AST board.

The PR machine is also finally working (it should have started 2 years ago really...), but it's true that it's all very much hanging in the air at present.

It's only because I think the CEO is a reasonably decent man (at least, for AIM standards) who has clearly been gradually learning how that game works that I'm still in.

Litigation finance businesses are a real thing and more and more popular.

They make money by getting a proportion of the damages or settlement money, and work with small businesses who would otherwise not have the budget to pay for expensive proceedings.

Their great benefit is that their customers can then still use top City law firms (which rarely work on a no-win no-fee basis - they are not an ambulance chasers!).

1- sometimes, one gets a better average rate if selling in multiple tranches rather than in one.
2- alternatively, regular daily selling is a good trick to keep the SP down, and sometimes more effective than selling everything in one go - in the latter case, the SP can easily bounce straight after, while it's much harder with regular selling.

Shedulike - assuming your intentions are good as you claim (no offense but plenty of liars on public BBs), I’m happy to explain off-BB why my comments amount to almost zilch in English defamation law and probably even less in the Slovenian equivalent. And amount to even further less insofar as actions under the EU’s main treaty or for other public / administrative law in the EU or Slovenia are concerned, which were what Colin suggested the actions from Ascent would probably be. The most beneficial impact of a court case for us would the massive (IMO) PR impact on such a small country as Slovenia. It would shine a big fat spotlight on it, advertising it as a place bad for foreign investment. The bribes from the Russian masters of JL and whomever else they have paid in the national Slovenian courts and Arso can’t make up for such a high potential economic loss. And arbitration (as suggested by CH during the interview) or an EU court action are sometimes much faster than national court actions - a few months (once the paperwork has been formally filed) to 1.5 years.
