Kenj, English law does not have the notion of “bankruptcy” for companies.
It has “dissolution” and “insolvency”.
Totally different legal mechanisms / statuses.
Even if AST were to become insolvent (= run out of money to meet its obligations) while the legal action still going on, it would definitely not have to be dissolved, and could instead be declared in administration, helping isolate it temporarily from all new claims from possible creditors.
A positive outcome from that court action could bring the money to make it go out of administration and back on its feet.
That very thing happened to the owner of Gaucho grills in the UK: the company is back on its feet after a period of administration.
