@jackb14 they will be discussing, the greed element is Elevra reducing costs but keeping 50 percent of off take etc.

Watch for MIIf sign off, as that will be the key trigger to say we are moving forward.

@RamonM in addendum this is in line with the spirit of the contract, shows willing intent on behalf of Atlantic. And supports Atlantic in any discussions, arbitration.

It can also trigger a reduction in elevras agreement, in either offtake or JV ownership, if they default/don’t pay within set time periods.

Elevra is playing the game so to speak, however ratification was the initial excuse. Now that has cleared it’s harder for them to objective, and even harder if Atlantic proceed with cash calls.

@RamonM If MIIF sign, Atlantic can move to monthly cash calls to progress. If elevra don’t start adding funding then they default.

However there will be some form of agreement in the background, to address the delta.

Positively in MIF’s recent strategic multi year plan, Atlantic and JV are included. So it would seem remove the blocker by mif signing, and get on with it.

More clarifying what they will pay for ownership. Which is fair enough.

Key point is if they keep cash in hand above 70 million. So they can provide evidence they can fund the initial stage, once everything is sorted.

At face value they should only be invited to bid for Atlantics, Not elevera share. leaving elevra to do what they wish I.e. don’t run a bid process. just sell the lot to an existing customer.

Moving these to a binding legal agreement, signed off is basically in Atlantics wheel house to deal with.

It would also explain the casual and fairly friendly tone that has been mentioned here in the call.

May thoughts on the hold up are:

MIFs 6% share, clarity on MIFs offtake agreement.

Currently non binding, these need to move to binding, which you could view as 6% of build costs and 6% of over runs MIF will pick up the tab.

On offtake, it’s a case of MiF can only bid for the Atlantic 50% on the market, and not elevras 50 percent.

Well, elevra have signed a contract, but don’t like the contract now.

I will go back to one single point, why does everybody just think we were the only JV partner that was approached?

When 2 x governments have stated that the JV may not be the company that ends up mining?

@ThetaDecay the company said they could take to arbitration. However back again to at what cost to elevra, that’s not cheap and not great for their reputation or needs.

They are backed in a corner, and it’s basically been done by what we are taking at face value, they won’t dilute to fund etc.

It’s just the usual corporate BS, who will blink 1st.

@RamonM remember the government are on side, and they have a right of refusal on any deal.

So something amicable is always best, shall we say.
