British Government minister we need to complain about the Slovenian Governments behaviour to.

I want to do this in the new year. Do I need to contact my local MP first who would then refer the information to Mr Fox?
We need to make our Government aware of the way the Slovenian Government treats companies that invest there. For example officially having no ban on fracking but unofficially making it almost impossible.

at the moment. Quite correct. It would be helpful to demonstrate to the World that ARSO do actually still issue permits. The damage to their economy due to this publicity must be massive. If the IPPC permit arrived there would also be more confidence in the future, so the silly share price would improve a lot.
However I believe ARSO and Mr Leben have really put their foot in it from the legal side. It is now just about totally undefencable. Nealy five years for a permit that should have taken less than 1. Then it was issued and illegally withdrawn. Then it was possibly illegally stopped by Mr Leben once more about 3 months ago. A solicitor is going to absolutely love this case. They should have tried to get the law changed so fracking was banned. That would have been the legal way to stop the fracking. I mean fracking is legal in Slovenia but it is suspected now that some people at ARSO don't like that. Also one minister is suspected of not liking that either. Now some suspect that ARSO and the minister are banning fracking via the back door. We call it "taking the law into your own hands". Oh dear is what we have done illegal? But this is Slovenia what does it matter? We can do what we like! Oh no what about EU law................................

I really would like a long chat with the x Director General of ARSO. I mean now he's been fired he should be able to tell the truth of what happened. I must admit that at one time we thought he was the one delaying things but it turned out he was one of the good guys it seems.
It was very interesting when Jure Leben suddenly got involved just as the IPPC permit was about to be issued and sacked the old director general delaying things for what is now, what......... another 3 months?? It makes it look like Jure Leben wants to delay the IPPC permit for as long as possible. I would not be surprised if that is the truth......... would anyone?

You need to take on board the fact that the well is no longer covering the running costs. Basically Ascents bank balance is now going backwards. In time Ascent will not be able to pay the employees in Slovenia as a direct result of ARSO and Jure Lebens actions, or should I say non-actions? Ascent will have no choice but to make the office and gas field employees redundant. Better to do that sooner rather than later. At least they know who to complain to........... hello Jure! Unless we get at least the IPPC permit within two weeks I have no doubt there will be Slovenian redundancies in January. The only good thing is Jure leben and ARSO will be to blame and the interest the Slovenian press has in this will mean it's all over the tv and papers over there. It really is crunch time whether Colin admits it or not. If I were Colin I would give it until the end of the 2nd week in January. No permit(s) then start the legal process for damages, then start the redundancy process, notify INA etc.... Presumably we would need to tell INA when the gas stops....... say end February. Then we would , I presume simply be paying for security at our plant in Slovenia.
Then we wait. probably for many months but eventually the EU courts will rule and we may be getting more like 3p a share compensation. That is the way I see it.

I'm sure Colin will update us if he hears anything but no doubt ARSO have been closed over Christmas. Maybe even if they were not they might say that to delay more anyway? That is the impression I get. We need to set a date for commencement of legal action sometime in January. Sooner the better frankly.
It's not Colin's fault. It is clearly and obviously ARSO and then Jure Leben's actions. They are the ones who will be in the news for all the job losses over there if that IPPC permit does not arrive within weeks. I understand we wil have a lot of publicity in the new year. I hope in the interviews Colin is more frank about the job losses that will happen if the permits don't arrive and more importantly who will be to blame directly. ARSO and Jure Leben, and it will be so obvious no complaints about rude emails will divert from Slovenian job losses. Shutting the whole thing down, making everyone redundant, then employing just security to look after the gear is a possibility if you ask me. Thet would concerve money to wait for the legal outcome. In fact Ascent could become almost dormant while the case is persued through the EU courts. We would just get the occasional update.
I for one won't let them get away with this.
Indeed I will take part in a further fund raising just to see them in Court.

For starters there is the illegal revoking on the IPPC license in 2016.
Then there is the 4.5 years (and counting..........) insane/mad/unbelievable delay with the IPPC license since the original one was illegally revoked. Apart from ARSO asking questions, then more questions, then more questions etc. (highly suspicious of deliberately delaying the permit), then as the icing on the cake Jure Leben's intervention. What a joke. What did he say? Was it they were looking into whether ARSO had been unjustly influenced by people! It was put over as if shareholders were to blame! So no influence by the NGO (the one on the tv program then!!!!). No influence by the man himself, Jure then? Is he "on the fence" here! What a total disgrace. Roll on legal action. I would like to see the defendants get off the hook here. They would need a miracle from what I have seen.

legal action can be financed (no-win, no-fee should sort that), the way the Slovenian authorities have behaved over the last nearly five years will ensure Ascent Plc will win. I see Reso (who I believe lives in Slovenia and objects to the Gas processing plant) says one of our partners submitted the application on behalf of Ascent. I see no reason at all why this should bar Ascent from legal action on it's own, assuming Geoenergo and Petrol don't want to take part. In fact Petrol is a very large Slovenian Plc and so I would have thought they would participate.
As I said in a previous post assuming the IPPC license is not with Ascent by mid-January I think Colin should instruct the no-win, no-fee solicotors. It will be interesting what ARSO do once they have checked out thier own legal position which i think is holed below the waterline regarding the 2016 revoke of the license.
Personally I am determined to make the Slovenioan Government compensate myself and all the other share holders.

in NOT banned in Slovenia. This is why Ascent invested 50 milllion Euros. The impression a lot of people get is ARSO and possibly Jure Leben have been influenced by NGO's to stop it happening. However of that is the case it is illegal. The Government should have introduced a law to ban it. They did not/have not. Indeed there is no mention of it happening either as far as I can see. This is why Ascent has such a good legal case, let alone the 2016 incident.

received the IPPC permit by mid January Ascent should tell whatever no-win no-fee Co that gives the best deal to launch a case to overturn the 2016 IPPC license withdrawal that Ascent stated back in 2016 they thought was illegal.
This is the most obvious way forward. A win would open the doors to compensation. I think the decision to revoke the license was more due to the influences of NGO's than following the rules and laws of Slovenian and the EU. It's ironic th\t Ascent and it's partners could get millions of Euros in compensation.

that ARSO are not as well organised as they probably should be. I think the same for the Ministry of Environment. The 2016 withdrawal of the IPPC license I believe leaves Slovenia wide open to a court case. Ascent did an RNS at the time stating they thought the withdrawal of the permit was totally illegal. Clearly Ascent did not need the permit for some years and so thought the easiest way forward was to simply re-apply. The more we learn about the way Slovenian ministers behave the better it gets. This is because they are in the EU. If they were not in the EU Ascent would be without hope. But they are and the behaviour of ARSO and Jure Leben is something that the solicitors are looking into as Colin has said. We will have to see but:-
1. Personally I'm 95% sure the withdrawal of the IPPC permit in 2016 was simply illegal. I expect a no win no fee solicitors will be launching the case early in the new year. I don't see how Ascent can lose.
2. Jure Lebens "internal review". I believe the solicitors are looking into whether this was within his powers and if it was legal to stop the permit being issued while the review was happening.
3. The ridiculous time ARSO have taken to process the application. Even if you take off the 3 or so years the one man who kept appealing against the permit delayed the process it has still taken about 2 years and counting for ARSO to process it when they say what....... 8 months was it? So there is obviously a case for over one years further delays directly due to ARSO. I mean what defence do they have??? |I don't see a defence.
All in all I think Ascent will eventually make more from damages than they have from the gas to date. We will have ARSO and Jure Leben to thank for this I believe.
I honestly think the Slovenian Government will lose the case to get back the IPPC permit due to it being illegally withdrawn in 2016. If we win that then damages can be claimed.................

This would not have been in an RNS unless they had checked it out.
Seems to me no win, no fee Solicitors would be falling over themselves to take up this case.
The application is back with ARSO and has been for about 2 weeks.
If I were Colin I'd whey up the best no win no fee solicitors on this then go for it in January.
I think the Slovenian systems/Government is going to pay big time for this.
They are not so good at a lot of things.

So in a way the Slovenian Government may be taking legal action against its self!!!! LOL!!!!!!
Oh dear. ARSO seems to have been influenced by NGO's etc. It seems that people in ARSO TOOK IT UPON THEMSELVES to delay and delay the permits. BUT there are RULES and there are laws both in Slovenia and in the EU which govern the permitting process and if you ignore them because you are influenced by NGO's you will end up in court. Also all this publicity has cost Slovenia tens, if not hundreds of millions of Euros in lost investment.

I would have thought it's given Flbe some breathiing space. Virgin, Stobart or some other. Setting up an airline to Flybe's extent would cost a few quid. I reckon it will get bought out and re-branded. maybe there are more involved than just Stobart and Virgin?

Ascent have invested about 50 million Euros in Slovenia. The Government and it's institutions are suspected of deliberately illegally stopping permits. If Ascent wins compensation as there are only 2 million Slovenians it would be about 25 euros for each Man, Woman and Child. However if Ascent can persuade the court that the business plan Ascent had was ruined because of the illegal delaying of the permits (is there a defence??) it would be more than double that. They could be looking at more than 100 million Euros (more than 50 euros for every permson in Slovenia).

the last RNS that said Ascent had been informed the internal review was over and recommendations were made to ARSO about how to improve their permitting system. Fair enough. Why that delayed Ascents permit another 6 weeks or so (and counting) is something the solicitors are looking into I believe. So the IPPC permit application that we have waited over FOUR AND A HALF YEARS was back with ARSO at least 2 weeks ago. The IPPC permit has still not been issued by ARSO strangely enough!
Over 2 weeks has gone by, yet the previous head of ARSO said it was about to be issued just before the review. We await the next problem that delays the permit even more. The legal argument in Ascents favour builds on a daily basis.

Colin says we have followed the proper processes so we should get the permits.
If we do not by early next year Ascent will be taking the Slovenian Government to court for damages.
I think they are also checking if Jure Lebens "internal review" delay was legal. If it was fair enough. If it was not.....
