Problems getting permits and complaining/taking legal action siting extreme delay often results in losing the action as there is not set time limit (i.e. x months, subject to x,y,z adding months years). I'm talking about many countries here. However Ascent have the fact the IPPC permit was awarded by ARSO in 2016, and, according to Ascent, illegaly revoked. Here is the RNS:-
www.investegate.co.uk/ascent-resources-plc--ast-/rns/ippc-permit-decision/201605061300025341X/
It seems to me they have a very strong case here, unless what Ascent say in the official RNS is not true. ARSO cannot argue they were incompetent in issuing the permit don't forget as that too would be their fault. It's difficult for me at least, to come up with a defence for ARSO, providing what Ascent said in the RNS is true. I'm sure Ascent know this but are bending over backwards to avoid legal action. I presume the legal team will be outlining Ascents position to ARSO's solicitors if they have not done so already. If I were ARSO I would be getting the IPPC permit issued before a legal case is started as IMHO they will loose it................ eventually.
All IMHO.
