Tarry it was the strength of such an outrageous claim of $7m on top of your consistent behaviour over the salary which quite frankly is getting on my nerves. As for your question... You are a business man and therefore I assume you send out invoices and you expect those invoices to be paid as they are for services you have supplied.

If you have supplied the goods then you are owed the sum pre agreed at contract until which time the debtor settles their bill and may even have a clause that allows for late payment interest.

Aminex have supplied gas at an agreed price and therefore TPDC owe that sum as contracted under the GSA.

I am not fully understanding the reason for the TPDC claim but it is a CLAIM AND NOT AN INVOICE for services provided and as you know Aminex do dispute it and say they have the facts and figure to support them.

You also know that many here feel that this was a trumped up claim to force the companies hand. I personally think the timing was close enough to be no coincidence to the fact they switched payments to wrls favour following their highly public claim against them and that this claim against us was perhaps used to stall out the fact they were short of cash to pay both.

You ask me to be extend courtessy. I am quite happy too but I wont stand by and ignore exaggeration of negatives for the sake of making a point we've heard more than once a day for nine months. I will still point out that a claim is not a debt and therefore we owe them nothing! It is therefore even in your own scenario incorrect until any claim is proven. It is merely a disputed sum.

Until the matter is resolved which as said we understand now may well have been, then it remains that way, "just a claim"

Further, because what they actually physically owe us outweighs any potential amount they could win in that claim, then we would not even be in their debt and therefore would owe them nothing. Even if we lost, this would be a balancing matter in our favour!

You admit it is a "Claim" My recollection is the claim was $5m The figure when broken down would have been in the the $3 million bracket due from us if the claim was proved warranted. John if you don't have the expertise the same question arises and you don't have the answers to the questions I put then how can you judge the situation until it unfolds? Right now all you and many are doing is making judgement based on understandable frustration.

I agree over comms as previously stated to GL and as one who has campaigned heavily with management for it over the last 18 months I shall continue to support that and reiterated in in my recent email to jay. As a solution to some of the ill feeling, I accept that fully GL Communication has left much to be desired!

I'm still not convinced the negotiation restrictions and FC regulation placed upon them would have allowed them to say too much more on the farm-out discussions but yes we should hear more from them
