Let’s just stop and think - Innova test has largely been discredited by FDA action but whatever it’s actual effectiveness it certainly appears to have helped us reduce the transmission of COVID. The NHS decided to give it EUA when they felt the demand was greater than what could be UK supplied - they will answer for that decision in time. Since then they have supported UK manufacturing including ODX to prepare for a time when a better sovereign test could be produced at scale. The FDA have certainly called out Innova for supplying to the US without authorisation but LFT remain a cornerstone of Joe Biden policy to defeat COVID it will also remain as a cornerstone of UK policy. HMG will have been alerted FDA findings and we already new that the EUA for Innova was due to be reviewed on 21st June, that is I week away. Even before the report many of us had anticipated it would not be renewed. The UK is ready, the haters will use this time to try and create a wobble and interested parties will take as much political advantage as they can but a proper gold standard sovereign test, supplied by ODX and two other UK companies will mean that we can expect LFT, as the only viable option for mass testing to be around for years to come. The bottom line for me is that with the potential demise of Innova test kits HMG are if anything likely to want to increase their anticipated order from 50 million per annum to our current maximum 100m production. Do well fear not.

If it makes you feel slightly better 1noise, I believe the stuff from Turkey along with billions of other items that were misordered will actually be used up within social care activities that have less stringent requirements.

I am thinking that, assuming Innova properly passed the PD testing (which I would like to believe), that the problem arises with quality control. Once accepted apparently we rely on the company’s own internal systems to ensure quality control. Remember this test is produced in China (have we mentioned that enough) and so we are unlikely to have people on hand for site inspections. This may help PD out of a fix but does not reflect well on any follow up systems that we as citizens and taxpayers might expect if our government was spending what is it, £2.8 billion so far. There can be no question that the EUA is not extended, that any outstanding payments are not made and that proceedings are undertaken to reclaim any money that is still traceable - not much I would expect from its Delaware registered supplier - just how many red flags are needed. Obviously I would then anticipate that whatever funding was intended to Innova is immediately redirected to the 3 chosen Bristish suppliers who once given the Soverign test details are asked to manufacture at full capacity and, I would expect, be asked to increase production levels as quickly as possible with the guarantee of several years contract.

I certainly agree that ODX should not try to put the knife in or be smug in any way but as has been suggested get in ahead of the pack by outlining clearly in a subtle way the positive benefits, that differentiates us from Innova without ever mentioning Innova or the potential issues that must surely ring loud over the weekend.

I think whichever the sovereign test is is has already gone through very extensive appraisal which will also give it legitimate homie use permission. In my view the more stringent the test the better the barrier to entry for other players.

The suggestion of impropriety should certainly help the government to repudiate the contact.

I hardly think that CK wants or needs to be the guy seen to be kicking HMG in the nuts at a time when they are obviously under pressure - there will be a queue of other willing and able to do that job for him.

We may certainly have felt he was an unreliable witness but Deeks has a platform, my suggestion was that he would be a useful advocate of UK produced LFT’s as he has been such a vocal critic of Innova up to this point. Let me be clear my own view is that the LFT market is massive and will remain with us for years to come, the demise of Innova is a positive thing for us as shareholders and can only help the rapid acceptance and roll out of a UK produced product.

I agree. Deeks actually confirmed that he was not against all LFT’s just some (read Innova). It would be easy for the LFT market to suffer as political advantage will be taken with suspicion over HMG’ s biggest spend. Innova produce various tests and it could well be that different devices were tested by PD and the FDA. Now is the time for Deeks to come out and say he supports a UK produced test that has been properly scrutinised and gone through the full gambit of testing and not nodded through with emergency approval. HMG will need to change the narrative and shout loudly about the soon to be introduced gold standard sovereign test manufactured in the Uk.

Probably because most British households and businesses have a least one box sitting around somewhere. The FDA had never approved Innova but it was being sold anyway - the U S can afford to be bold I expect HMG will find things a little more tricky, saving face and not scaring the horses - the Innova tests have obviously worked to a degree and we did authorise them they are just not as good as everyone was led to believe. Obviously good news for ODX but skilful management required so that all LFT’s do not become damaged goods.

Can only agree wessley, with Innova off the table, as surely they must be, the £374m 2 year contract will be maxed out and more orders will follow. Feels good that we have been proved right, we will sell all that we can produce 100m and growing. £1billion market cap here we come. Hold Hard and dont sell out too cheaply, you have earned your reward.

Well I had hoped for more but MH did confirm again that having a standing testing capacity was one of the most important lessons that HMG had learned so that must bode well for us.

The only answer that I can bear Aberdeenman is that we were not ready as a nation to produce at the volume required - we are doing something about that but I can’t help feeling that our current stock levels of the Innova test is holding us back. It is biased in that it does not present any counter arguments as you suggest but it has no duty to be balanced and the information it details is certainly interesting.

Goodness that is a very interesting if rather frustrating read. I feel angry but this adds much ammunition to a UK produced LFT industry in which ODX can play a substantial role - the sooner the better!

Thank you Avizabdum, to be quite clear, I respect Regulators position, the law is the law but I am sure he would probably agree that the bringing of such cases as we are discussing here were not brought about or funded by those in love with the law but by those trying to achieve political advantage - other cases might well be more about righting wrong. I have enjoyed our little tussle today, if for nothing else than it has been a reasonable debate and has meant I have avoided most of the drivel and pointless aggression that the other posts have largely contained. I always read Regulators posts, he is insightful and brings a level of knowledge to this board that is often somewhat lacking, I will continue to follow him and accept we may not always agree but we both seem to believe in ODX, agree that today’s court ruling does not play against us and that by holding we will do very well. I am confident that you have acted properly at all times and have no idea of the level of stress your own department may have been under but as you are on the front line I would not expect you to be the one throwing stones at others who may have been under more pressure or had more challenging events to deal with. The resources of the state come with endless hoops to jump through just to get the job done - I am sure you are aware of this and might perhaps be more understanding to others that, without any intention of wrong doing fail to cross all bridges in the right order. I am no fan of cronyism and have at various points during the pandemic looked scornfully on some of the things that the press have bought to light or have at least suggested were or may have been undertaken - Han****’s pub landlord suddenly producing glass vials spring to mind but in most part I am supportive of the decisions that have to be made in haste by those that have the best interest of the nation at heart - I would have hoped that as a fellow combatant you might have felt the same.
