I have some questions regarding this letter,
1. Dont you think this might pressurise BOD to accept any deal on the table to please the investors ASAP? IMO this might not deliver long term value for shareholders but look good in short term. I for once dont believe that there are no talks at the moment unless the science is not right.
2. Ousting BOD as per the letter, how will this help? It would tank the sp and only delay any ongoing discussions about the deal. You dont know the new BOD would be any different or it might just be the situation
3. Do you expect BOD to provide updates every week/ month / 2 months even if nothing new has happened. Maybe you need to appoint the Aligh guy for PR who will tweet the progress every hour. Guys, the trial for 401 is complete and until deal is signed off there wont be any news..
4. Will the action help if the VAL is about to raise funds? If this get bad, sp would tank and shares will be issued at lower price than it would be.
5. Is this the only company on AIM who behaves like this? No look at CLLN on main market where BOD lied about their debt and it went bust. Also look at TPOP from where it has fallen and the change of BOD has not helped the downward spiral.
In my opinion, if things are bad it will be bad even if you change BOD but if things are rolling behind the doors, this would only cause drop in sp or delays in signing the deal.
Will legal action or suspension of trading help in short term? Probably no..
I was also in from 72p fays with small holding but now averaged down and hold a considerable size.
