Going on the paragraph below from daniel1son post this morning, it does seem to say that the court has heard the oral arguments of counsel. So to me that looks like the draft that Frr have put togeather, comes from what was heard in chambers from the judge.

Even though this is now looking to only be going one way, I would still think best not to be thinking on relisting part at the moment.

Above, is only my way of looking at it.

Below, is how I also see it & on that being right then Hopeless is in a Hopeless situation.

In my experience these orders are dictated by judges in chambers in front of counsel after having heard submissions and arguments from both sides.

Once the order has been dictated it is then submitted for formal submission and subsequent release on court headed/stamped (ie, official) paper to all parties concerned.

The difference here appears that we are seeing the interim process, ie, that part between the judges’ commentary and the formal issue of the order. To my thinking it is now merely a matter of time before this order is issued by the court and enforced. Depending on the speed it could be as soon as next week.

The most important point in the oder has got to be item 2: ‘Plaintiffs are likely to succeed on the merits of their claims for Breach of Fiduciary Duty and Duty of Loyalty’. It would be suicide to attempt to even contest that and I am hoping now this will bring matters to a close.

Not that often we have seen very positive new like this for a while that was posted by daniel1son, earlier this morning. So thought post it again, as it is very pleasant to read.

Now, the good news and as I expected:

2. The Court finds that Plaintiffs are likely to succeed on the merits of their claims for Breach of Fiduciary Duty and Duty of Loyalty.
3. The Court further finds that unless a temporary restraining order is granted, irreparable harm will result to Plaintiffs.
4. And, the Court finds that the balance of harms and the public interest favor granting injunctive relief to Plaintiffs.
Therefore, and with good cause shown,

Worth noting though, that doc hasnt been signed by the judge / clerk yet and is called a proposed order, so not 100% sure if that's gone through.

Would think that it is to stop Hopeless going ahead with his taking assets & then Frr proceeds with its case against Hopeless.

I presume the judge who drafted that judgement will be same judge looking at the restraining order.
If above, is right then would have thought there will not be a problem,?

Now hopefully the mind changers will see that Frr are still alive & certainly kicking & very hard.

As usual gipps, is coming over with thoughts that it is over when it is not.

The injunction was kept active & Hopeless was after the lot from the start. The only way we will find out for sure why this has now gone over to California, is very likely from Caymans & one reason might be to put more pressure on Hopeless, as he can lose much more than before.

This message, is a basic one that will be sent out & does not really change anything on what is happening at the moment.

Until we see something official of which Caymans can deliver on then let's hope, it is very soon.

Just looks like a follow on from proposed summons.

Frr had right to appeal, so would have thought if it was case it had all gone wrong then why would they have not gone for appeal. Especially going on last write up.

The judge was on A/L 2/3 weeks ago & last week was supposed to be writing up judgements.

Fairly sure that part of the ijunction that Frr have applied for, is to stop Hopeless interfering with running of Frr.
So just on the basis of stopping frr gaiing the loan, he is bigtime. Especially as that would provide Frr on making payment on the $2M or a larger settlement offer.

The waste of space, is even now, still going on about a private company.

What you say, is correct. On that though, it was the case in the Caymans, but Hopeless now can be destroyed on a trial by jury in California of which was not really the case before.
