I appears that Alphonso/LG et al. have a lot to answer for but the whole sorry affair probably stimulated Tremor to doing even better elsewhere.

So, it appears that, if anything, the spat with Alphonso has not been such a bad thing after all.
However, there is every reason to claim damages and compensation/repayment of loaned cash, and etcetera.

Tremor has aired a grievance against Alphonso in court.
It is now up to a judge to decide, unless Alphonso/LG settle out of court.
Anything else is speculation.

I can see that after the contract was broken a judge has said or implied that LG et al. are now banned from using any (Tremor-related) data in the future.
And some companies seem to fit somewhere between the two main parties in terms of data flow and access, or otherwise, which is contentious?

Wasn't aware about the Nielsen ownership bit.
The whole affair is quite complex and I suspect a judge would make much more sense of the black and white stuff.
It can't be easy to work out a financial loss for damage to Tremor arising from misuse of sensitive data after the contract was severed when LG acquired Alphonso.
Plus, have we heard what Alphonso reply in defence to all allegations/assertions?

Still trying to get my head round the following issues:

LGE more recently provided data from Alphonso to Gracenote, under license.
Gracenote contracted to provide it to its customers, including FourthWall.
The one that is a tort, the actionable illegal piece is the Agreement between Alphonso and
Gracenote.

Previously, since 2016, Tremor and Alphonso entered into a partnership agreement pursuant
to which Tremor would license viewership data from Alphonso.

Is that making any sense?

I have to admit that I do not know what damages Tremor have filed for.
If they don't know what they want then is it left to the courts to decide, assuming it eventually goes that way.
Surely it is better for Tremor to state the case for a definite sum of money.

I think you are misreading my first paragraph.
I know lawyers/attorneys get paid regardless.
Except where they agree a contingency fee arrangement, the person who represents you will get paid by taking a percentage of your award as a fee for services. If you lose, the attorney receives nothing. The downside is that they typically want a large percentage of the award.

I too could not give a toss about the case and it seems to have been promulgated by the V.I.

In the absence of any certainty, regarding legal fees recovery by the prevailing party, nobody in their right mind would sue in the U.S. unless the expected award (for damages arising) would substantially cover their legal expenses.

Did Alphonso deliberately break their contract with Tremor?
Did this cause harm to Tremor?
Did Alphonso act deliberately in order to cause harm arising?
Do Alphonso still owe money loaned to them by Tremor?
Can it be proved that it was a loan to Alphonso by Tremor and on what terms?

Perhaps it depends on who has the deepest pockets?
Tremor look to have been subject to a material breach of contract by Alphonso.
If Tremor are owed money then that should be covered by the loan contract details.
Alphonso are now owned by LG.
The case will probably be settled out of court with LG stating it implies no admission of guilt.

There are also exceptions to the general rule. These include cases where a successful claimant recovers no more than nominal damages; or where the winner acted improperly or unreasonably during proceedings.
In exercising its discretion on costs, the court is required to have regard to all the circumstances.

I am reading a lot of attention directed to the Alphonso case here (and elsewhere).
stt1 is having a 'hay day' playing with everyone's opinions.
Yet another example of the nuisance-value of his insinuations.
Tremor would not decide to list in the U.S. because of a spat with a company that would lead to a discount placing.
That is absolute rubbish!
