Reports are if there is any wrong doing it has been continuing from when Barrick first set up the operations i.e. Not when Acacia set the processes up. If so why should we accept a discounted offer, we should actually be receiving an increased offer for the systems in place that we have inherited. If the problems have been kept quiet then that important information should have been fed to shareholders previously, as this would have affected our share buying choices. If you ask me more than one set of rules have been broken here by Barrick and we should be paid compensation. Anyway we only owe a third and so the 2/3rds should be met by Barrick in anycase. They as you say are trying to stop this things going through the roof. I hope they cannot stop the lid blowing off this thing as we should now be moving up fast.

Acacia say they will consider an offer that raises sufficient minority shareholder support. i.e. AN INCREASED OFFER.

The Barrick offer was a distraction holding the Gold price back. I feel without any interference we should now drift back up to over £2 a share rising current Gold prices. The Govt of Tanzania are desperate for overseas aid and investment, they now have China (who Acacia we know have been talking to some of their own Companies in private about a share) as their largest contributor and so I cannot see them doing anything silly, because if they do it will put the fear of the witch doctor into prospective investors who would no doubt then prefer to go somewhere else.

I see an international arbitration court calling on World experts to determine the worth of samples taken from the containers. They will use expert labs for this determination and it will be interesting to see what is within the soil sample. If it is held that Acacia are right then the export ban can be lifted, even if it was a half way house agreement a settlement will be made and the export ban will be lifted. Even if Acacia are wrong I doubt they will be liable for the equivalent of the GOT ten years national domestic product. As found with many disputes once an independent panel reviews quite often the relations improve and this will benefit ultimately Acacia and the GOT. However Barrick if they had been conducting on the same basis previously to what Acacia inherited and lets face it Acacia has only been running in its own name for a few years then Barrick might be held responsible in any case for the period of time they were responsible for the mines in Tanzania. Every way you look at this the Acacia loss is not as large as Barrick are making out, and if fact their own loss could be a lot more.

Very clever game on Barrick's part here. They say they have a deal but have not presented it. The terms of the legal standstill are as we know until the deal is complete. They have not presented the deal because if it is not complete the Arbitration will move forward straight away. They are playing the we want your cake and want to eat it. They were clever in taking away the deadline requirements on the deal, however I suggest Acacia should reintroduce this in the absence of the deal being presented and this will force the issue. I do not feel the GOT will seize as if they do again the standstill in place will be waived and they have a lot to lose, we are talking a risk for them of several hundred millions of dollars. The stupid thing is it would not seem too difficult for Acacia to also prove that we (as Acacia shareholders) have suffered as a result of Barrick's past actions and they therefore will also be found to answer for a lot of punishment here in my opinion too. The sensible thing is for a fair deal but if it does not come forward I feel the lawyers will be talking turkey!! I do not see this actually as a long term bad thing. As we have said before most disputes are settled either by a change of govt. or on the Courts by their Insurers lawyers.

Odey are buying more shares here now, and they definitely agree the price offer from Barrick should be far more.

Yes very true BB, you are as you say quite accurate generally and no one can be sure of the timing in these things. As such I took the pleasure of having a look at Short tracker for Acacia, and found nothing and so searched again, and still found nothing on Acacia and then a more in depth search found that MW reduced their short to below 0.50% on the day of the AGM. So we have no shorts recorded now in excess of the recording 0.50% level and we know they work with Blackrock we have appeared to have got information in advance and so perhaps next week we will get something coming? If not I am quite happy to wait for the half year results where we are now up almost 10% for the Gold price in GBP. Yes my experience from the Insurance World is most disputes for the biggest of claims are settled last minute on the court steps.

Hi Chaps, I do find it hard to understand as BB said the other day it would appear as if the AGM was undertaken without any concern and conducting as per a normal meeting, (which shows no sign of panic, or stress by the BOD) with not even the suggestion of the needs for an Extraordinary Meeting, and yet we are being told Barrick are interested in buying us out on the the cheap, with no formal offer presented at present and only two days left to do so. I find this as a very strange situation. I suppose my brain is now programmed past this now and looking forward to next months half year results which will be based on let's face it an ever increasing average general Gold price for the year.

Just looked and when converted over into sterling that has fallen further against the Dollar Gold price is now up 9.94% for the year, can you believe that. I see this share being even more attractive when looking at the currency play for foreign and particularly USA investors coming in here to buy!!! Does this ting any bells?? I also have noticed the Acacia price going up in late trade when the NYSE is open and interestingly the local Tanzanian exchange the DSE was up yesterday 3.80% at close and today was showing signs of being up 3.95%.

Gulf talks of conflict with the USA now as more tankers are attacked right under the eyes of the US Navy patrols, and still talk of a US Fed rate cut will help us here. I am quite happy to slowly drift higher and back up towards £2 a share again.

I see the Odey newscast and we are all the same on that one. We just need to see a reasonable offer, or some better news to balance that we have had for the past two years. The tide will turn eventually. I am pleased the BOD got some more powers to control the share allocation in the Company and this is a good step to defend our position for a low stupid offer that is not reasonable. From memory Barrick now only have about 4 days to make a formal offer.

Also to be honest for approval are Resolution 15 & 16 shares for cash 5%, and 17, Directors to make purchases of up to 10%.

This does not look to me like a lifeboat coming to a sinking ship. Rather one that wishes to motor under its own steam!!

Article 14 is interesting from a stop the takeover point of view. i.e. Approved is being sought to issue £13.5m to be allot by Directors and a further £13.5m for a rights issue, to be approved and this represents 33% of the Company in new shares? Could this be a way to retain control and even take control of their Company with new shares?

I understand the Kenyan Govt and the Tans Govt are trying hard to improve relations as it seems they have not always got on. If it is found what is expected i.e. A massive Gold find for mining than I can see the Kenyan Govt wanting a slice of Acacia and why not come in here now and buy out Barrick. I am sure the Govt of Mali might want a share too. I am sure we will not be short of takers.

I'm hoping ACA announce quotes now obtained and mining to start in Kenya, and likewise ops are expanding in Mali and Burkino Faso (all where funnily enough Barrick's MB has said in the press he wishes to expand into).
This will raise our share price whether Barrick come in or not, and we will not be reliant on just one Country, which let's face it has not been the easiest to work in. I am hoping we will not have to take action against Barrick for putting us in this position to begin with, and whilst giving the impression that the problems had found a conclusion when they had not and so some such as myself had been encouraged and relied on these updates to buy more shares on the back of the reports.

Gold and Silver going up again today and not sure what RBC are up to with their Hokey Cokey? i.e. In out, in out, shake it all about. As you both say not long to go now to the AGM.

So this afternoon we have advised RBC are taking a short position of 0.01% , but as soon as that is announced they have bought back in and closed off their shorts to have nil again, all in the space of a few hours and so I reckon they must have seen the sudden increase with the FMR LLC going to over 5.74% with 100 m shares and panicked!! I wonder if something is going to be announced or presented at the AGM? This is starting to now become far more interesting to me.

Just seen apart from RBC, FMR LLC on behalf of Barrick is increasing its shares now from 3.17% to over 5.17% they hold over 100m shares now. They have overtaken Blackrock who now own 5.65%. Our share price is now moving up fast just before the AGM. I always believe in everything comes to he who waits.
