Just seen this article https://www.belfastlive.co.uk/news/northern-ireland It is very anti the marine license what I found interesting is this comment towards the end of the article 'A DAERA spokesperson said: "A pre-application letter was received in April 2021, indicating intent to request a Judicial Review should a positive decision be made on the licence. At this point papers seeking Leave to apply for Judicial Review have not been served on the Department."' The article was updated yesterday so it looks we will have to wait until tomorrow to see if they do file for leave as they do not appear to have done so yet.

I am new to this share and would be glad if someone could clarify something for me. In today's RNS reference is made to Q3 drilling. Does anyone know is this drilling for oil or gas or is it exploratory drilling to see if there is oil or gas there?

In a slight tick up from January just noticed on the Belfast Harbour website that the Dublin Swift is due to arrive tomorrow fora 3 day visit. It is currently scheduled to be in dry dock until Friday.

Chrisatrdg ref 10.28 post The pre action protocol letter it refers to does not stop the clock it is a procedural step and puts DAERA on notice of a potential claim. The letter and the time to respond must all be done within the three month time limit. This avoids a claimant sending a pre action protocol letter two days before the time limit expiring to gain more time.

Jabido ref 08.37 post assuming the rules in Northern Ireland are the same as in England and Wales when somebody issues a Judicial Review claim they have to serve it on the Defendant and any interested party. In this case No Gas Caverns have until the Court offices shut tomorrow to issue the claim. They then have to serve the claim on the Crown Solicitor on the behalf of DAERA and the solicitors for HARL as an interested party. So if no judicial review claim is received with the claim sealed by the Court with a date on or before tomorrow then none was issued in time.

i suspect that if nothing is heard before a clerk from the Crown Solicitors Office will check on Wednesday to see if one was issued. it would be up to either HARL or DAERA to issue any statement on the matter. I am not aware of a system similar to the American PACER system that would allow online searching of the court records so you will have to hope a statement is released.

We should know by the end of the week if an in time Judicial Review has been lodged. Even though the proceedings will be against DAERA assuming that the procedures are the same as in England and Wales HARL as an interested party should be served with the papers as well. My personal view is that a Judicial Review may not transpire in time. The reason for this is that the crowdfunding page has only raised £10,442 against a £15,000 target so it looks like they may not have raised the money in time. There is a question would give them an extension of time to file the claim. In the circumstances of this case I do not expect the court to grant an extension of time.

oldtramp ref 16.09 post assuming that the rules in Northern Ireland and England are the same. The claim has to be issued within three months. The pre action protocol letter is a procedural step to try and avoid a judicial review by showing what the arguments are. The theory being that if a strong enough case is shown in the pre action protocol letter the relevant public authority will consent to the decision be quashed so saving money.

With less than a week before the time limit to bring a JR expires I checked and the crowdfunding is at 69%. If I recall correctly the crowdfunded money will only be released if the entire target is released. So it looks like the JR may not go ahead because of lack of funds. We should get confirmation of whether the JR was issued some time after Wednesday of next week.

Not sure if there is any relevance to HARL in this but just saw this on the House of Commons twitter feed UPDATE: Victoria Prentis will no longer be giving a statement. A statement from George Eustice on a Northern Ireland update will now be going ahead instead.

What I find interesting is that the statement was originally going to be made by the Minister of State and is now going to be made by the Secretary of State at DEFRA. I wonder what is going to be said as part of this is devolved. Watch the SP around 4pm.

Tonyh1975 ref 08.55 post I am not sure how much you know about Judicial Reviews but on the basis that the procedure in Northern Ireland and England and Wales are essentially the same can I clarify matters. The proceedings will not be against HARL. The proceedings will be against the DAERA Minister who was the decision maker. HARL, as an interested party, will be entitled to appear but is not obliged t take any part in the proceedings. They could decide to leave it entirely to the Crown Solicitor. In fact it could be argued that unless HARL has any different points to make it might make sense to let DAERA to do this on their own.

Those of you who are interested in going to the Investors day on 15 February 2022 for institutional Investors or 16 February 2022 have until 3pm on Friday to book. The email I received states 'Spaces are limited and will be offered on a first come first served basis. We are accepting RSVPs until Friday 4 February at 3pm.' It also says the event is from 12pm and 3pm and a light lunch will be provided.

TheEast ref 10.45 post I checked the No Gas Caverns crowd funding page yesterday and they have only raised two thirds of the money needed for the JR. Also they only have a week to file the JR before the time limit expires assuming it has not already. The question then becomes do they wish to issue the jR and hope they raise the money. On the question of how long a delay any JR will cause I am declining to openly express a view.
