Tonyh1975 ref 08.55 post I am not sure how much you know about Judicial Reviews but on the basis that the procedure in Northern Ireland and England and Wales are essentially the same can I clarify matters. The proceedings will not be against HARL. The proceedings will be against the DAERA Minister who was the decision maker. HARL, as an interested party, will be entitled to appear but is not obliged t take any part in the proceedings. They could decide to leave it entirely to the Crown Solicitor. In fact it could be argued that unless HARL has any different points to make it might make sense to let DAERA to do this on their own.
