It's not a 'NO' from me at all. The question is irrelevant. Colin is going the no win no fee route we believe. He's not actually saying anything currently but that is what he has said previously when he was communicating. No point in keeping asking the same question over and over when it's not going to happen.

If the lawyers said AST is likely to win they would take it on a no win no fee basis as they believe they would be paid at the end.

kenj, to answer your last question. We don't know EU or Slovene law (although I suspect lejjb has some idea). The lawyers Colin will be dealing with in London and in Ljubljana will know the relevant laws and will know whether to take the case or not. We will find out soon enough.

So Gorazd Marincek has lost his status with the NGO that lost in court to AST, with the court calling him vexatious. He now acts as a spokesperson for ROVO against Magna. He also has the ear and ideological sympathy of Jure Leben as the Environment Minister. So he can't personally act as an appellant in court but he can still advise the Minister and others who can act against AST. Amounts to the same result in the end doesn't it? It doesn't have to be his name on the court records.

Ah! But he just is TPT. Clearly Jure Leben is not following the court ruling and is indeed taking notice of his views, whatever he is meant to do. It's Slovenia you see. They don't follow the rules, their own or the EU's. We've established that now. That's how Colin should have a good case against them and hopefully has the lawyers to deliver it.

Er no ... we won't stop blaming Mr. Leben duster as he is to blame, along with the NGO activist leader who is still very active despite apparently losing his NGO status. And I believe JL was elected in a coalition government where he is given the job as Environment Minister. He wasn't elected to that post. Green candidates (observe the spelling - use a spell check as you can't spell) are often quite hysterical about green issues and often have very biased and impractical views.

We're all angry duster and some of us have considerable paper losses which could imminently become all too real. Shouting your mouth off with angry nonsense doesn't help.

Apparently losing his NGO status hasn't stopped him from appealing against the Magna permit. TPT, just stating that he's lost his status hasnt changed anything. GM is still directly involved.

I sold over 2 million of my holding here on Friday as I am seriously concerned at what two people (JL and GM, the NGO) have done and are doing to this company. I got little for it and would happily like to see both get their marching orders, preferably off a cliff. The SP has gone below the figure we had after the disastrous RNS of 6th August. I am now seriously concerned at the direction of this company after JL and GM have caused the current ongoing problems.

Even with the permits being issued right now the damage is too great. The IPPC as a permit has little value as it would be dangerous for AST to invest a further 10 million in Slovenia. Stimulation permits would be helpful as AST could stimulate the wells and send the subsequent stable gas flow to INA to their processing plant at Molve in Croatia. However stimulation by compression technology could be done without the permits but AST would need funding for that. At the current SP funding from a placing would most likely give insufficient return to fund well stimulation. So they need the permits to initially get the SP up with more investor interest to have a placing at a decent price.

Catch 22 comes to mind but I'm really too pi**ed about the whole issue to have a sense of humour about it.

I don't think kenj has grasped the concept of no win no fee. The current financial position of AST would have no bearing on a litigation law firm to take on the case. It would be entirely down to whether they considered they could or would win the case. They may even have to consider, in the case of taking the Slovene government to court, whether the Slovene government would ignore any court ruling and not pay out. Litigation firms do the work to make money and the defendant would have to be able to pay and would actually pay out and not hide away refusing to pay.

By the way polemic is what you have been in your last posts directed at me. Argumentative would be another term.

SP going below 0.3p. Colin needs to respond to share holder's concerns. Those selling now have clearly lost all confidence in AST at this very low SP. And they would have been the ones with most confidence as others would have sold a lot sooner. Not many of us left.

Colin needs to be proactive right now. Not just behind the scenes with the lawyers but up front with shareholders or he'll end up with no shareholders at all.

Not interested in polemics. The thread title gives the clue to the way this should go. AST have no money to fund legal action. Your points are valid but beggars can't be choosers now. Let's see what happens. It's either wait for the permits or legal action or both. We're all hostages now as the SP is so low.

There's a very good reason why we're not being told. If they say 'yes' then that goes against the fundamental position of JL and his environmental activist friends. If they say 'no' that would open them up directly to legal action. The current procrastination position they have taken up leaves AST in limbo and running out of money and ARSO can always state the delay is due to the process ARSO have to go through and may also insist on further requirements. Colin needs to get moving with legal action to cut the stalemate otherwise AST will run out of money and may be forced to pull out. That's just what JL wants.

Colin has a U.K. law degree. He would need to have used Slovene lawyers for a Slovene contract agreement. He is not qualified to practise in Slovenia. But he should be able to understand the terms and conditions of legal contracts, agreements and the strategy of the Slovene lawyers for any forthcoming litigation.

Having reread your post kenj I realised I was incorrect to say you pronounced the 'way forward'. However your post was entirely negative and incorrect in assuming no win no fee was unlikely to be possible and stating it being unlikely any law firm would take AST on without up front payment and then stating our leaving the EU could effect an ECJ court judgement.

Membership of the EU and the ECJ are two different things although membership of the EU normally means membership of the ECJ. Non membership of the EU doesn't preclude membership of the ECJ and nor does it mean Slovenia doesn't have to abide by ECJ judgements just because we wouldn't be in the EU, although we still will be for the transition period and quite possibly for longer the way things are going.

There have been examples of oil and gas companies using no win no fee litigation lawyers and Colin has the expertise with his law degree to get the best and to understand the case they can build.

There have been a number of posts here and on Twitter where posters are clearly not in a position to make assertions and statements that they are making. That doesn't mean Colin will be right and we have seen many errors of the BoD over the months and years. But he is well positioned with his expertise to deal with this problem.

This one area where Colin has got expertise. He has a law degree as well as being a chartered accountant. His current silence may well be because he is getting on with constructing a case with U.K. and Slovene lawyers rather than heeding much ignorant noise from many on here and on Twitter. Kenj states he has no legal experience but then pronounces the way forward despite having no legal experience.

I would agree with HS69 except for twp points. Firstly in an ideal world we'd have balance where the environment was protected at the same time as sufficient energy was provided to the people. Gas is the better option right now for the environment compared to coal or wood burning. Secondly no raise will be required as there is the option of no win no fee lawyers which, I believe, Colin is currently dealing with in London and Ljubljana.

It gets dangerous for a country when one person with a group of followers can so easily stop industry and commerce. He's not the Messiah, he's just a very naughty boy.

The country's government and legal system has to be able to cope with such people. Not only can the Slovene government not cope they positively favour the influence of such people. And when you have an Environment Minister with the attitude of JL well .....

Ah! But TPT said he had lost his NGO status. As if that would stop him. Just shows the naivety of some.
